7 An Act relating to Route 66; amending Section 1,
Chapter 412, O.S.L. 2022 (69 O.S. Supp. 2024, Section
8 4040), which relates to the Oklahoma Route 66
Commission; removing expiration date of the Oklahoma
9 Route 66 Commission; amending Section 2, Chapter 412,
O.S.L. 2022 (69 O.S. Supp. 2024, Section 4041), which
10 relates to the Oklahoma Route 66 Commission Revolving
Fund; modifying conditions for budgeting and
11 expenditures of funds; and providing an effective
date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
15 SECTION 1. AMENDATORY Section 1, Chapter 412, O.S.L.
16 2022 (69 O.S. Supp. 2024, Section 4040), is amended to read as
17 follows:
18 Section 4040. A. There is hereby created until June 30, 2027,
19 the Oklahoma Route 66 Commission. The Commission shall be composed
20 of nine (9) members. The members shall serve as follows:
21 1. One member shall be appointed by the Governor and selected
22 from the Commissioners of the Oklahoma Tax Commission, whose first
23 term shall be for one (1) year, and then renewable for three-year
24 terms thereafter;

1 2. One shall be the Executive Director of the Oklahoma
2 Department of Transportation, or his or her designee, whose first
3 term shall be for two (2) years, and then renewable for three-year
4 terms thereafter;
5 3. One shall be the Executive Director of the Oklahoma Tourism
6 and Recreation Department, or his or her designee, whose first term
7 shall be for three (3) years, and then renewable for three-year
8 terms thereafter;
9 4. Three members shall be appointed by the President Pro
10 Tempore of the Oklahoma State Senate of which:
11 a. one shall be a citizen of a county containing a
12 portion of Route 66, whose first term shall be for one
13 (1) year, and renewable for three-year terms
14 thereafter,
15 b. one shall be a city manager, assistant city manager,
16 or economic development director for a municipality on
17 Route 66 with a population greater than ten thousand
18 (10,000), whose first term shall be for two (2) years,
19 and renewable for three-year terms thereafter, and
20 c. one shall be an Oklahoma citizen with expertise or
21 experience in historic preservation, whose first term
22 shall be for three (3) years, and then renewable for
23 three-year terms thereafter; and

1 5. Three members shall be appointed by the Speaker of the
2 Oklahoma House of Representatives of which:
3 a. one shall be a citizen of a county containing a
4 portion of Route 66, whose first term shall be for one
5 (1) year, and then renewable for three-year terms
6 thereafter,
7 b. one of whom shall be a business owner whose business
8 is located along Route 66 within a city or town whose
9 population is less than ten thousand (10,000), whose
10 first term shall be for two (2) years, and then
11 renewable for three-year terms thereafter, and
12 c. one shall be an Oklahoma citizen with expertise or
13 experience in marketing, whose first term shall be for
14 three (3) years, and then renewable for three-year
15 terms thereafter.
16 B. The Commission shall utilize the Oklahoma Route 66
17 Commission Revolving Fund as authorized in Section 2 of this act.
18 SECTION 2. AMENDATORY Section 2, Chapter 412, O.S.L.
19 2022 (69 O.S. Supp. 2024, Section 4041), is amended to read as
20 follows:
21 Section 4041. Oklahoma Route 66 Commission Revolving Fund.
22 A. There is hereby created in the State Treasury a revolving
23 fund to be designated as the "Oklahoma Route 66 Commission Revolving
24 Fund", which shall consist of all monies appropriated, transferred,

1 or otherwise designated to the fund by law. The revolving fund
2 shall be a continuing fund, not subject to fiscal year limitations,
3 and shall be under the administration of the Oklahoma Route 66
4 Commission. All monies accruing to the credit of said fund are
5 hereby appropriated, and shall be budgeted and expended in
6 accordance with the provisions of subsection B of this section for
7 the purpose of preserving and developing Route 66 and commemorating
8 the Route 66 Centennial.
9 B. No funds Funds shall be budgeted or expended from the
10 Oklahoma Route 66 Commission Revolving Fund prior to July 1, 2023,
11 or prior to the approval by the Legislature of promulgated permanent
12 in accordance with rules adopted by the Commission pursuant to the
13 provisions of the Administrative Procedures Act.
14 C. The Oklahoma Route 66 Commission shall promulgate, pursuant
15 to the provisions of the Administrative Procedures Act, permanent
16 rules subject to approval by the Legislature, to implement:
17 1. Application procedures for projects submitting requests for
18 funds;
19 2. Processes for awarding of funding applications;
20 3. Details of the Commission's general duties;
21 4. Reporting requirements of the Commission to the Legislature;
22 and
23 5. Any other rules necessary to carry out the purpose and
24 mission of the Commission as expressed in this act.

1 D. All unencumbered funds remaining in the Oklahoma Route 66
2 Commission Revolving Fund upon the expiration of the Oklahoma Route
3 66 Commission shall be transferred to the State Treasurer for
4 deposit in the General Revenue Fund.
5 SECTION 3. This act shall become effective November 1, 2025.
