6                            AS INTRODUCED

7   An Act relating to renewable energy; placing a

    moratorium on construction or expansion of certain

8   wind and solar energy facilities in this state;

    prohibiting the permitting of certain facilities;

9   making certain exceptions; providing for

    codification; and declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14  SECTION 1.      NEW LAW  A new section of law to be codified

15 in the Oklahoma Statutes as Section 180.14 of Title 17, unless there

16 is created a duplication in numbering, reads as follows:

17  A. The Oklahoma Legislature hereby establishes a moratorium on

18 the construction or expansion of any new or existing wind or

19 utility-scale solar energy facilities in this state pursuant to the

20 provisions of this act. Unless otherwise repealed or revoked by the

21 Oklahoma Legislature, the moratorium shall be in effect indefinitely

22 beginning upon the passage and approval of this act.

23  B. Subject to the moratorium set by subsection A of this

24 section, no state agency, authority, board, commission, committee,

1 department, trust or other instrumentality of this state or

2 political subdivision thereof, nor elected or appointed officer,

3 member of any governing body or other person designated to act for

4 an agency or on behalf of the state, or a political subdivision

5 thereof, shall permit the construction or expansion of wind or

6 utility-scale solar energy facilities in this state.

7   C. Nothing in this section shall be construed as affecting or

8 intending to affect:

9   1. Any construction or expansion of wind or utility-scale solar

10 energy facilities in this state that were properly permitted for

11 construction or expansion and that have obtained official approval

12 from the Regional Transmission Organization and are commercially

13 operable prior to the passage and approval of this act; or

14  2. The operation of wind or utility-scale solar energy

15 facilities in operation prior to the passage and approval of this

16 act.

17  SECTION 2. It being immediately necessary for the preservation

18 of the public peace, health or safety, an emergency is hereby

19 declared to exist, by reason whereof this act shall take effect and

20 be in full force from and after its passage and approval.
