7   An Act relating to the State Department of Health;

    creating the Barbara Weber Amyotrophic Lateral

8   Sclerosis (ALS) Grant Program; placing the program at

    a certain agency; providing purpose; requiring

9   certain reports; establishing the Barbara Weber

    Amyotrophic Lateral Sclerosis (ALS) Grant Program

10  Revolving Fund; establishing fund nature; authorizing

    certain budgeting and expenditure of funds for

11  certain purposes; providing for codification;

    providing an effective date; and declaring an

12  emergency.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16  SECTION 1.      NEW LAW  A new section of law to be codified

17 in the Oklahoma Statutes as Section 1-580 of Title 63, unless there

18 is created a duplication in numbering, reads as follows:

19  This act shall be known and may be cited as the "Barbara Weber

20 Amyotrophic Lateral Sclerosis (ALS) Grant Program".

21  SECTION 2.      NEW LAW  A new section of law to be codified

22 in the Oklahoma Statutes as Section 1-580.1 of Title 63, unless

23 there is created a duplication in numbering, reads as follows:

1   There is hereby created the Barbara Weber Amyotrophic Lateral

2 Sclerosis (ALS) Grant Program which shall be administered by the

3 State Department of Health. The program shall grant funds to

4 support research for Amyotrophic Lateral Sclerosis (ALS) and for

5 programs that help support Oklahoma residents afflicted with ALS or

6 Oklahoma residents caring for a family member afflicted with ALS.

7 Beginning July 1, 2026, the State Department of Health shall provide

8 an annual report to the Governor, the Speaker of the Oklahoma House

9 of Representatives, the President Pro Tempore of the Oklahoma State

10 Senate, Appropriations and Budget Chair of the Oklahoma House of

11 Representatives, and the Appropriations Chair of the Oklahoma State

12 Senate that includes, but is not limited to, how many grants have

13 been awarded during the previous fiscal year, which entities the

14 grants have been awarded to, and for what purposes the funds are

15 supporting.

16  SECTION 3.      NEW LAW  A new section of law to be codified

17 in the Oklahoma Statutes as Section 1-580.2 of Title 63, unless

18 there is created a duplication in numbering, reads as follows:

19  There is hereby created in the Oklahoma State Treasury a

20 revolving fund for the State Department of Health to be designated

21 the "Barbara Weber Amyotrophic Lateral Sclerosis (ALS) Grant Program

22 Revolving Fund". The fund shall be a continuing fund, not subject

23 to fiscal year limitations, and shall consist of all monies received

24 by the State Department of Health from appropriations, donations,

1 grants, or other sources of funding specifically designated for

2 deposit to the Barbara Weber Amyotrophic Lateral Sclerosis (ALS)

3 Grant Program Revolving Fund. All monies accruing to the credit of

4 said fund are hereby appropriated and may be budgeted and expended

5 by the State Department of Health for the purpose of the Barbara

6 Weber Amyotrophic Lateral Sclerosis (ALS) Grant Program.

7 Expenditures from said fund shall be made upon warrants issued by

8 the State Treasurer against claims filed as prescribed by law with

9 the Director of the Office of Management and Enterprise Services for

10 approval and payment.

11  SECTION 4. There is hereby appropriated to the State Department

12 of Health from any monies not otherwise appropriated from the

13 General Revenue Fund of the State Treasury for the fiscal year

14 ending June 30, 2026, the sum of One Million Dollars ($1,000,000.00)

15 or so much thereof as may be necessary to perform the duties imposed

16 upon the State Department of Health by law.

17  SECTION 5. This act shall become effective July 1, 2025.

18  SECTION 6. It being immediately necessary for the preservation

19 of the public peace, health or safety, an emergency is hereby

20 declared to exist, by reason whereof this act shall take effect and

21 be in full force from and after its passage and approval.
