7   An Act relating to schools; amending Section 1,

    Chapter 281, O.S.L. 2023, as amended by Section 1,

8   Chapter 354, O.S.L. 2024 and Section 2, Chapter 281,

    O.S.L. 2023, as amended by Section 2, Chapter 408,

9   O.S.L. 2024 (70 O.S. Supp. 2024, Sections 5-148.1 and

    5-148.2), which relate to school resource officers;

10  extending school resource officer pilot program to

    five years; increasing School Security Revolving Fund

11  cap; providing an effective date; and declaring an

    emergency.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16  SECTION 1.      AMENDATORY  Section 1, Chapter 281, O.S.L.

17 2023, as amended by Section 1, Chapter 354, O.S.L. 2024 (70 O.S.

18 Supp. 2024, Section 5-148.1), is amended to read as follows:

19  Section 5-148.1. A. The State Department of Education shall

20 establish and maintain a three-year five-year pilot program known as

21 the School Resource Officer Program.

22  B. School resource officers employed or contracted by school

23 districts participating in the School Resource Officer Program shall

24 successfully complete law enforcement active shooter emergency

1 response training given by the Council on Law Enforcement Education

2 and Training (CLEET) and approved by the Department of Public

3 Safety.

4   C. 1. A school district participating in the School Resource

5 Officer Program shall give first priority to employing or

6 contracting with a law enforcement officer with sworn authority and

7 training in school-based law enforcement and crisis response who is

8 assigned by an employing law enforcement agency to work

9 collaboratively with one or more schools using community-oriented

10 policing concepts.

11  2. If a law enforcement agency that serves the area in which a

12 school district is located is unwilling or unable to provide a law

13 enforcement officer described in paragraph 1 of this subsection, a

14 participating school district may employ or contract with a retired

15 law enforcement officer or an armed security guard who is licensed

16 pursuant to the Oklahoma Security Guard and Private Investigator

17 Act. The law enforcement agency that serves the area in which the

18 school district is located shall preauthorize any individual

19 employed or contracted with under this paragraph. The school shall

20 require a background check on the individual. The law enforcement

21 agency that serves the area in which the school district is located

22 shall allow an authorized individual employed or contracted with the

23 school district access to the preauthorizing agency's radio system,

24 pursuant to this paragraph, and a police band radio system which may

1 be used by the individual in the performance of his or her duties to

2 be paid for by the employing district. A school district may use

3 funds from the School Security Revolving Fund created pursuant to

4 Section 5-148.2 of this title to cover the cost of the radio system.

5   SECTION 2.      AMENDATORY  Section 2, Chapter 281, O.S.L.

6 2023, as amended by Section 2, Chapter 408, O.S.L. 2024 (70 O.S.

7 Supp. 2024, Section 5-148.2), is amended to read as follows:

8   Section 5-148.2. A. There is hereby created in the State

9 Treasury a revolving fund for the State Department of Education to

10 be designated the "School Security Revolving Fund". The fund shall

11 be a continuing fund, not subject to fiscal year limitations, and

12 shall consist of all monies received by the State Department of

13 Education from:

14  1. Reimbursements, grants, or other monies received from other

15 state agencies and entities for school security;

16  2. Reimbursements, grants, or other monies received from the

17 United States government obligated to school security projects;

18  3. Gifts, donations, and bequests; and

19  4. Monies appropriated or apportioned by the Legislature.

20  B. All monies accruing to the credit of the School Security

21 Revolving Fund are hereby appropriated and may be budgeted and

22 expended by the State Department of Education for the purposes of:

23  1. Establishing and maintaining a School Resource Officer

24 Program; and

1   2. Providing physical security enhancements for schools

2 including, but not limited to, school resource officers, cameras,

3 gates, lighting, locks, doors, windows, security geofencing,

4 ballistic storm shelters, and mobile panic alert systems.

5   Monies in the School Security Revolving Fund shall supplement

6 and not supplant existing school security funding.

7   C. Expenditures from the School Security Revolving Fund shall

8 be made upon warrants issued by the State Treasurer against claims

9 filed as prescribed by law with the Director of the Office of

10 Management and Enterprise Services for approval and payment.

11 Expenditures from the School Security Revolving Fund shall not

12 exceed Fifty Million Dollars ($50,000,000.00) Seventy-five Million

13 Dollars ($75,000,000.00) in any fiscal year and shall be divided

14 equally among every public school district in the state.

15  SECTION 3. This act shall become effective July 1, 2025.

16  SECTION 4. It being immediately necessary for the preservation

17 of the public peace, health or safety, an emergency is hereby

18 declared to exist, by reason whereof this act shall take effect and

19 be in full force from and after its passage and approval.
