7   An Act relating to the Department of Public Safety;

    requiring Department establish and maintain pursuit

8   alert system; listing components of system; stating

    when alerts shall be issued; listing requirements of

9   alerts; authorizing the promulgation of rules;

    providing for codification; and providing an

10  effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.      NEW LAW  A new section of law to be codified

16 in the Oklahoma Statutes as Section 2-140b of Title 47, unless there

17 is created a duplication in numbering, reads as follows:

18  A. The Department of Public Safety shall establish and maintain

19 a pursuit alert system to alert drivers of active police pursuits

20 occurring in their immediate area. The alert system shall include,

21 but shall not be limited to, the following components:

22  1. Collaboration with mobile carriers and notification services

23 to send real-time alerts directly to drivers' mobile phones via text

24 messages, push notifications, or other mobile communication methods;

1   2. Integration with any existing highway electronic message

2 boards in the area to display real-time updates about the location

3 and direction of an active pursuit;

4   3. Limitation on the area of notification to a radius around

5 the pursuit to be determined by the Department.

6   B. Alerts of a pursuit shall only be issued when a law

7 enforcement agency confirms that an active pursuit is ongoing, and

8 that pursuit poses a significant risk to the public and when public

9 notification is deemed likely to reduce the risk of harm or assist

10 in the safe resolution of the pursuit.

11  C. The pursuit alert system shall provide clear, concise and

12 timely information about the pursuit, such as the make, model, and

13 color of the vehicle, its last known location, and direction of

14 travel. Notifications shall be issued in a manner that minimizes

15 driver distraction and promotes safety. Alerts shall be deactivated

16 once the pursuit has ended or is no longer a threat to public

17 safety.

18  D. The Department is authorized to promulgate any rules

19 necessary to effectuate the provisions of this section.

20  SECTION 2. This act shall become effective November 1, 2025.
