Relates to prevailing wage requirements applicable to brownfield remediation work performed under private contract as it relates to certain remediation activities, for sites that are seeking or have received a determination that the site is eligible for the tangible property credit component of the brownfield redevelopment tax credit, and the work is paid for in whole or in part by public funds.

VETO MESSAGE - No. 114 TO THE SENATE: I am returning herewith, without my approval, the following bill: Senate Bill Number 5379, entitled: "AN ACT to amend the environmental conservation law and the labor law, in relation to prevailing wage requirements applicable to brownfield remediation work performed under private contract" NOT APPROVED This bill would require prevailing wage as a condition of entering into the brownfield cleanup program (BCP), a voluntary program that offers tax credits towards the remediation and development of contam- inated sites. The bill would authorize the Department of Environmental Conservation (DEC) to terminate a BCP agreement for violations of the new labor provisions.
