VETO MESSAGE - No. 146 TO THE SENATE: I am returning herewith, without my approval, the following bill: Senate Bill Number 5170, entitled: "AN ACT to amend the civil practice law and rules, in relation to permitting a plaintiff to recover against a third party defendant in certain cases" NOT APPROVED This bill amends the Civil Procedure Law and Rules to allow an injured plaintiff to directly recover from a third-party defendant on a judgment for contribution or indemnification when the defendant/third- party plaintiff fails to satisfy the underlying judgment upon which the contribution or indemnification is based. In particular, the bill would overturn Court of Appeals precedent and longstanding State policy by requiring workers' compensation insurance to pay for the unsatisfied amount of any judgment obtained by an injured worker in applicable cases.
