Allows for the donation of personal property of the state to certain not-for-profit organizations that are up to date on annual filings.

VETO MESSAGE - No. 65 TO THE ASSEMBLY: I am returning herewith, without my approval, the following bill: Assembly Bill Number 4723, entitled: "AN ACT to amend the state finance law, in relation to allowing for the donation of personal property of the state to certain not-for- profit organizations" NOT APPROVED The bill would allow for the donation of personal property of the state to certain not-for-profit organizations. While I understand the goals of the legislation, the bill raises concerns related to the constitutional prohibition of gifts. Article VII, Section 8 of the New York State Constitution prohibits the State from giving money to corporations and associations. Property of the State being donated would constitute such a gift.
