AN ACT TO AUTHORIZE THE MISSISSIPPI DEPARTMENT OF
TRANSPORTATION TO DONATE TO THE CITY OF RIDGELAND, MISSISSIPPI, A CERTAIN
PARCEL OF LAND SITUATED IN RIDGELAND, MISSISSIPPI; TO STIPULATE THAT THE STATE
OF MISSISSIPPI SHALL RETAIN MINERAL RIGHTS; TO AUTHORIZE THE DEPARTMENT OF
TRANSPORTATION TO CORRECT ANY DISCREPANCIES IN THE LEGAL DESCRIPTION OF THE
PROPERTY PROVIDED IN THIS SECTION; TO AMEND SECTION 1, CHAPTER 414, LAWS OF
2025, TO CORRECT THE METHOD BY WHICH THE STATE HIGHWAY COMMISSION, ACTING ON BEHALF
OF THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION, IS AUTHORIZED TO DONATE TO THE
CITY OF GULFPORT, MISSISSIPPI, CERTAIN PARCELS OF LAND SITUATED IN GULFPORT,
MISSISSIPPI, AT THE INTERSECTIONS OF 13TH STREET AND 28TH AVENUE AND 15TH
STREET AND 28TH AVENUE; TO AMEND SECTION 1, CHAPTER 393, LAWS OF 2019, TO
PROVIDE THE MISSISSIPPI DEVELOPMENT AUTHORITY TO SELL CERTAIN REAL PROPERTY
LOCATED IN LOWNDES COUNTY AND THE CITY OF COLUMBUS, MISSISSIPPI, TO PROVIDE
THAT ANY PROCEEDS GENERATED FROM THE SALE OF THE LAND SHALL BE DEPOSITED INTO
THE MISSISSIPPI EXISTING INDUSTRY PRODUCTIVITY LOAN PROGRAM BOND SINKING FUND;
TO PROVIDE THAT MDA MAY CORRECT ANY DISCREPANCIES IN THE LEGAL DESCRIPTION OF
THE PROPERTY; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE
LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1.  (1)  The
Mississippi Department of Transportation is authorized to donate to the City of
Ridgeland, Mississippi, at no cost certain real property and any improvements
thereon located in Ridgeland, Mississippi, and being more particularly
described as follows:

Parcel

COMMENCING
at a found 1" square iron bar representing the Northwest corner of Section
24, Township 7 North, Range 1 East, Madison County, Mississippi, having grid
coordinates N= 1,070,881.727, E= 2,350,696.771 based on the Mississippi State
Plane Coordinates System, West Zone, NAD83 (93), coordinates and courses herein
are grid values based on said coordinate system, using a combined factor of
0.999954143 and a delta alpha angle of plus (+)00°06'17'' as developed by the
Mississippi Department of Transportation for this Project; run thence South
44°02'38" East a distance of 6906.45 feet to the Old Agency Road Project
Centerline at Station 25+50.68, as shown ·on the Appraisal Maps for Project
ACNH-9204-00(001) (100486/201000), and thence South 18°35'37" West a
distance of 49.86 feet to the present (2006) Southern right-of-way for the
existing Old Agency Road and a found 1/2" iron rod, same being the
Grantor's Northwest property corner, and being the Point of Beginning for the
parcel of land herein conveyed:

From said
Point of Beginning run thence along said Southern right-of-way line, same being
the Grantor's Northern property line courses of South 71°13 '20" East a
distance of 123.92 feet to a point being 47.59 feet Southerly of said Project
Centerline at Point of Curve Station 26+75.76, and thence Southeasterly along
the arc of a curve to the right with a radius of 832.88 feet, an arc distance
of 120.63 feet and a chord bearing South 68°1 I '59" East for a distance
of 120.53 feet to the Grantor's Northeast property corner and a found concrete
right-of-way marker; thence run South 00°19'42" East along the Grantor's
Eastern property line a distance of 467.16 feet to the Grantor's Southeast
property corner and a found W' iron rod; thence run North 87°29'05" West
along the Grantor's Southern property line a distance of 305.53 feet to the
Grantor's Southwest property corner and a found 5/8" iron rod; thence run
·along the Grantor's Western property line courses of North 05°31' 14"
East a distance of 419.48 feet to a found W' iron rod, and thence North
15°15'35" East a distance of 125.28 feet to said Point of Beginning,
containing 3.2393 acres (141,104 square feet of land, more or less, and being
situated in and a part of the Southeast Quarter (SE Y.) of the Southeast
Quarter (SE Y.) of Section 24, Township 7 North, Range 1 East, City of
Ridgeland, Madison County, Mississippi, and

The above
described parcel of land being a part of that certain tract of land acquired by
Grantor by virtue of that certain Deed recorded in Deed Book 1802 at Page 497
in the Office of the Chancery Clerk for Madison County, Mississippi.

(2)  The State of
Mississippi shall retain all mineral rights to the real property transferred by
means of donation under this section.

(3)  The Mississippi
Department of Transportation is authorized to correct any discrepancies in the
legal description of the property provided in this section.

SECTION 2.  Section
1, Chapter 414, Laws of 2025, is amended as follows:

Section 1.  (1)  The State
Highway Commission, acting on behalf of the Mississippi Department of Transportation,
is authorized to * * *
transfer donate to the City of Gulfport, Mississippi, certain
real property and any improvements thereon located in Gulfport, Mississippi, for
the purpose of public use or private sale and being more particularly
described as follows:

(a)  The Northwest
Quadrant of the intersection of 13th Street and 28th Avenue in the City of
Gulfport, Harrison County, Mississippi, including Lots 15 through 19 in Block
176 of Original Gulfport; and

(b)  The Southwest
Quadrant of the intersection of 15th Street and 28th Avenue in the City of
Gulfport, Harrison County, Mississippi, including Lots 1 through 6 in Block 176
of Original Gulfport.

(2)  Of the property
described in subsection (1) of this section, it is hereby understood and agreed
by the City of Gulfport, Mississippi, as the grantee herein named, that all
existing utilities located on, under or above the property herein described,
shall remain at the discretion of the utility owners, and that the grantee, its
assigns or successors in the title will not require the relocation of these
utilities except by agreement with the utility owner.

(3)  The State of Mississippi
shall retain all mineral rights to the real property transferred by means of
donation under this section.

(4)
The Mississippi Department of Transportation is authorized to correct any
discrepancies in the legal description of the property provided in this
section.

(5)  In the event that the
City of Gulfport determines to offer either parcel for sale, the Mississippi
Department of Transportation shall have the right of first refusal.

SECTION 3.
Section 1, Chapter 393, Laws of 2019, is amended as follows:

Section 1.  (1)
The Mississippi Development Authority is authorized to sell, lease or otherwise
dispose of, in whole or in part, in a manner as determined in the sole
discretion of the authority, the following described real property and any improvements
thereon:

TRACT I DESCRIPTION #1:

Commencing
at a set nail in pavement at the SW 1/4 of the NW 1/4 of Section 15, T-18-S, R-18-W,
Lowndes County, Mississippi; thence N88°35'46"E, a distance of 499.86 feet
to the point of beginning and at state plane coordinate N1456560.6170
E1113430.5090, based on NAD-83, Mississippi East 2301 zone; from said point of
beginning thence N00°45'46"W, a distance of 751.70 feet; thence
N12°17'40"W, a distance of 169.79 feet; thence N05°28'05"W, a
distance of 263.88 feet; thence N06°23'26"W, a distance of 152.45 feet;
thence N87°58'02"E, a distance of 1,534.95 feet; thence S39°27'31"W,
a distance of 1,076.12 feet; thence S50°32'29"E, a distance of 41.01 feet;
thence S39°27'31"W, a distance of 669.20 feet; thence S88°02'45"W, a
distance 368.41 feet to the point of beginning located in the NE 1/4 of the NW
1/4 and the NW 1/4 of the NE 1/4 of Section 15, T-18-S, R-18-W, Lowndes County,
Mississippi and containing 28.4373 acres, more or less.

TRACT
II DESCRIPTION #1:

Commencing
at the SE corner of Block 11, lot 6 of the Interstate City Addition, City of
Columbus; thence N27°15'13"E, a distance of 412.90 feet; thence
N50°32'29"W, a distance of 159.57 feet; thence N50°32'29"W, a
distance of 30.01 feet to the point of beginning and at state plane coordinate
N1457279.0334 E1114792.1955, based on NAD-83, Mississippi East 2301 zone; from
said point of beginning thence S37°48'10"W, a distance of 390.43 feet;
thence N50°32'29"W, a distance of 246.76 feet; thence N39°27'31"E, a
distance of 390.27 feet; thence S50°32'29"E, a distance of 235.48 feet to
the point of beginning, located in the Block 12, lot 3, 4, 5 & 6 of the
Interstate City Addition, City of Columbus and containing 2.1603 acres, more or
less.

TRACT
II DESCRIPTION #2:

Beginning
and Commencing at the SE corner of Block 11, lot 6 of the Interstate City
Addition, City of Columbus and at state plane coordinate N1456791.4860
E1114749.4870, based on NAD-83, Mississippi East 2301 zone; thence
N50°32'29"W, a distance of 235.19 feet; thence N37°48'10"E, a
distance of 403.74 feet; thence S50°32'29"E, a distance of 159.57 feet;
thence S27°15'13"W, a distance of 412.90 feet to the point of beginning,
located in the Block 11, lot 3, 4, 5 & 6 of the Interstate City Addition,
City of Columbus and containing 1.8287 acres, more or less.

(2)  The
Mississippi Development Authority may pay the cost  of title search, perfection
of title, title insurance, legal fees and recording fees and other costs as may
be required to sell, lease or otherwise dispose of the property.

(3)
In the event that any or all of the real property and improvements described in
subsection (1) of this section is sold, the real property shall be sold
for not less than the current fair market value as determined by the average of
two (2) appraisals by qualified appraisers, one (1) of whom shall be
selected by the * * *
Department of Finance and Administration Mississippi Development
Authority, and both of whom shall be certified and licensed by the
Mississippi Real Estate Appraiser Licensing and Certification Board.

(4)
Any proceeds from the sale of the land, and any improvements thereon, listed in
subsection (1) of this section, shall be deposited into the * * *state land acquisition fund Mississippi Existing Industry Productivity Loan
Program Bond Sinking Fund, established under Section 57-93-1, and
administered by the Mississippi Development Authority.

(5)  The * * *Department of Finance and Administration Mississippi
Development Authority may correct any discrepancies in the legal
description of the property provided in this section.

SECTION 4.  This act
shall take effect and be in force from and after July 1, 2026.
