SECTION 1. Chapter 21 of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by inserting after chapter 21O the following chapter:- CHAPTER 21P. MASSACHUSETTS HOTEL PACKAGING REDUCTION ACT Section 1. As used in this chapter, the following words shall have the following meanings unless the context clearly requires otherwise: “Department”, the department of environmental protection. "Hotel", a building or portion of a building regularly used for the lodging of guests including an apartment hotel, a motel or a boarding house, regardless of whether meals are served. "Hospitality personal care product", a product provided by a hotel and intended to be applied to or used on the human body or any part thereof for cleansing, conditioning or moisturizing including, but not limited to, shampoo, conditioner, lotion and liquid soap. "Small plastic bottle", a plastic container with a capacity of less than 12 ounces. Section 2. A hotel shall not provide any small plastic bottle containing a hospitality personal care product. Section 3. A hotel that violates section 2 shall receive a warning notice detailing the hotel's requirement to correct the violation within thirty days from the date the notice is sent. A hotel shall be liable for a civil penalty of two hundred fifty dollars for the first violation after receiving a warning and failing to correct the violation within thirty days and five hundred dollars for any subsequent violation in the same calendar year. A hearing or opportunity to be heard shall be provided prior to the assessment of any civil penalty. Section 4. The department shall enforce the provisions of this act. Section 5. This act shall take effect January 1, 2027.
