Chapter 175 of the General Laws is hereby amended by inserting after Section 47UU the following section: Section 47VV. (a) For the purposes of this section, the following term shall have the following meaning unless the context clearly requires otherwise: “medical tattoo”, a medically necessary tattoo used to restore the appearance of a patient’s skin, conceal surface defects, or mark the treatment site of a patient. (b) Any policy, contract, agreement, plan or certificate of insurance issued, delivered or renewed within or without the commonwealth shall provide coverage for medical tattoos when deemed medically necessary by a physician. The commissioner shall promulgate regulations to implement this section.
