1 AN ACT relating to road projects and declaring an emergency.
2 Be it enacted by the General Assembly of the Commonwealth of Kentucky:
3 Section 1. Notwithstanding KRS 48.110, 48.300, and 176.430, the projects
4 authorized by the General Assembly in this Act constitute the official 2026-2028 Biennial
5 Highway Construction Plan.
6 Section 2. The General Assembly acknowledges that the project authorizations
7 contained within this Act are based on the Transportation Cabinet's estimates. The
8 Transportation Cabinet shall have the authority to expend funds necessary to complete
9 the projects as authorized in this Act, amended only by variations dictated by bid or
10 unforeseen circumstances.
11 Section 3. The Secretary of the Transportation Cabinet shall produce a single
12 document that shall detail the enacted fiscal biennium 2026-2028 Biennial Highway
13 Construction Program, the 2028-2032 Highway Preconstruction Program, and the Local
14 Assistance Road Program.
15 Section 4. Notwithstanding KRS 48.300, this Act in conjunction with 2026
16 Regular Session HJR 75 and HJR 76 shall constitute the Six-Year Road Plan.
17 Section 5. Whereas the funding for these projects is provided by the
18 Transportation Cabinet Budget Bill, which takes effect upon its passage and approval by
19 the Governor or upon its otherwise becoming a law, an emergency is declared to exist,
20 and this Act takes effect upon its passage and approval by the Governor or upon its
21 otherwise becoming a law.
22 Section 6. The 2026-2028 Biennial Highway Construction Plan is as follows:
