Senate substitute for house bill No. 2212
An Act concerning extraordinary events; authorizing the governor to issue a proclamation declaring the need for enhanced public safety and security for an extraordinary event; providing the governor with certain authority during an extraordinary event declaration.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) (1) If an extraordinary event is hosted in Kansas or in any county bordering Kansas that causes a significant impact in Kansas, the governor, upon making a finding that such event will attract a significant number of visitors to the state that would burden the ability of local agencies and law enforcement agencies to maintain public safety, transportation services, security or other essential infrastructure without additional resources and coordination, may issue a proclamation declaring the need for enhanced public safety and security for such an extraordinary event.
(2) Such extraordinary event declaration may be valid for up to 15 days and may be extended by the legislative coordinating council for a period not to exceed 90 days. At any time within such period, the legislative coordinating council may terminate the extraordinary event declaration. The legislative coordinating council shall meet to discuss extraordinary event declaration extensions regardless of whether the legislature is in session or not in session.
(b) A proclamation declaring the need for enhanced public safety and security for an extraordinary event shall activate the disaster response and recovery aspects of the state disaster emergency plan and any local and interjurisdictional disaster plans applicable to the areas of the state and any political subdivisions thereof that are affected by the proclamation. Such proclamation shall constitute the authority necessary for the deployment and use of any forces to which the plan or plans apply and the use or distribution of any supplies, equipment, materials or facilities assembled, stockpiled or arranged to be made available for an extraordinary event.
(c) (1) A proclamation declaring the need for enhanced public safety and security for an extraordinary event shall authorize the governor to:
(A) Utilize all available resources of the state government and each political subdivision as reasonably necessary to cope with the extraordinary event;
(B) transfer the supervision, personnel or functions of state departments and agencies or units thereof for the purpose of performing or facilitating public safety and security activities;
(C) require and direct the cooperation and assistance of state and local governmental agencies and officials;
(D) make requests for funding or other aid from the federal emergency management agency; and
(E) make requests to the state finance council for funding from the state emergency fund.
(2) A proclamation declaring the need for public safety and security for an extraordinary event shall not authorize the governor to exercise any power described in K.S.A. 48-925, and amendments thereto, other than the powers described in paragraph (1). If the governor determines that additional emergency powers are necessary, the governor may issue a state of disaster emergency proclamation pursuant to K.S.A. 48-924, and amendments thereto.
(d) As used in this section, "extraordinary event" includes, but is not limited to, the world cup hosted by the international federation of association football, the olympics, the super bowl hosted by the national football league, a national political convention or an event that is similar thereto in scope and size with respect to expected attendance and public safety and security requirements.
(e) This section shall be a part of and supplemental to the Kansas emergency management act.
(f) The provisions of this section shall expire on July 1, 2027.

Sec. 2. This act shall take effect and be in force from and after its publication in the Kansas register.
