Senate File 426 - Introduced SENATE FILE 426 BY COMMITTEE ON NATURAL RESOURCES AND ENVIRONMENT (SUCCESSOR TO SSB 1041) A BILL FOR An Act relating to strict liability for a person in control of 1 hazardous substances. 2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 3 TLSB 1456SV (2) 91 sb/js S.F. 426 Section 1. Section 455B.392, subsection 1, paragraph a, 1 Code 2025, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (5) The reasonable costs incurred by the 3 state or its political subdivisions or the agents of the state 4 or a political subdivision for the oversight and monitoring of 5 a hazardous condition caused by that person. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 Current law imposes strict liability on a person having 10 control over a hazardous substance for certain costs. This 11 bill imposes strict liability on a person having control over a 12 hazardous substance for the reasonable oversight and monitoring 13 costs expended by the state or political subdivision related to 14 hazardous conditions created by that person. 15 -1- LSB 1456SV (2) 91 sb/js 1/ 1
