NEW SECTION . 8A.311C Contracts —— state moneys 1 or tax credits. 2 A contract for a project that is funded with state moneys 3 or tax credits shall contain a provision requiring that only 4 a product or material manufactured in the United States be 5 purchased for the project if it is possible to do so. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 Under current law, the department of administrative services 10 must give preference to purchasing American-made products and 11 purchases from American-based businesses if the life cycle 12 costs are comparable to those of products sold by foreign 13 businesses. In addition, as a condition of receiving an annual 14 appropriation relating to state government administration and 15 regulation, an entity receiving the appropriation must give 16 first preference when purchasing a product to an Iowa product 17 or a product produced by an Iowa-based business, and second 18 preference to a United States product or a product produced 19 by a business based in the United States. This bill requires 20 that a contract for a project funded with state moneys or tax 21 credits must include a provision requiring only products and 22 materials manufactured in the United States be purchased for 23 the project if it is possible to do so. 24 -1- LSB 2274YH (2) 91 sc/ns 1/ 1
