Section 725.1, subsection 2, paragraph b, Code 1 2025, is amended to read as follows: 2 b. A person who purchases or offers to purchase services as 3 a partner in a sex act from a person who is under the age of 4 eighteen , or who is reasonably believed to be under the age of 5 eighteen including a law enforcement officer or agent posing as 6 a minor under the age of eighteen, commits a class “D” felony. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill relates to prostitution. 11 Current law provides that a person commits a class “D” felony 12 when the person purchases or offers to purchase services as a 13 partner in a sex act from a person who is under the age of 18. 14 The bill adds that it is a class “D” felony for a person 15 to purchase or offer to purchase services as a partner in a 16 sex act from a person who is reasonably believed to be under 17 the age of 18 including a law enforcement officer or agent 18 posing as a minor under the age of 18. A class “D” felony is 19 punishable by confinement for not more than five years and a 20 fine of at least $1,025 but not more than $10,245. 21 -1- LSB 2126YH (3) 91 as/js 1/ 1
