House File 138 - Introduced HOUSE FILE 138 BY RINKER A BILL FOR An Act relating to the Iowa rules of criminal procedure 1 including the right to a speedy trial. 2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 3 TLSB 1968YH (3) 91 as/js H.F. 138 Section 1. SUPREME COURT —— RULES OF CRIMINAL PROCEDURE 1 REVISIONS. The supreme court shall revise rules of criminal 2 procedure 2.33(2) and 2.33(3) to provide that a defendant must 3 be brought to trial within one hundred twenty days after an 4 indictment is found or after a change in venue is granted by 5 the court. The revised rules of criminal procedure shall be 6 submitted for legislative council review no later than October 7 14, 2025. 8 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 9 importance, takes effect upon enactment. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill relates to the Iowa rules of criminal procedure 14 including the right to a speedy trial. 15 The bill directs the supreme court to revise the rules of 16 criminal procedure to provide that a defendant must be brought 17 to trial within 120 days after an indictment is found or after 18 a change in venue is granted by the court. Current rules 19 require that a defendant must be brought to trial within 90 20 days after an indictment is found or after a change in venue 21 is granted by the court. The bill requires the revised rules 22 to be submitted to the legislative council for review no later 23 than October 14, 2025. 24 The bill takes effect upon enactment. 25 -1- LSB 1968YH (3) 91 as/js 1/ 1
