    2         An act relating to anaphylaxis in public and charter
    3         schools; amending s. 1002.20, F.S.; requiring each
    4         district school board and charter school governing
    5         board to require that a school that serves students in
    6         kindergarten through grade 8 provide specified
    7         training to an adequate number of personnel; requiring
    8         that the training include recognizing the signs of an
    9         anaphylactic reaction and administering an epinephrine
   10         delivery device; requiring each district school board
   11         and charter school governing board to require that a
   12         student’s emergency action plan remain effective at
   13         all times while the student is on school grounds;
   14         requiring the State Board of Education, in
   15         consultation with the Department of Health, to adopt
   16         rules by a specified date; providing an effective
   17         date.

   19  Be It Enacted by the Legislature of the State of Florida:
   20  
   21         Section 1. Paragraph (q) is added to subsection (3) of
   22  section 1002.20, Florida Statutes, to read:
   23         1002.20 K-12 student and parent rights.—Parents of public
   24  school students must receive accurate and timely information
   25  regarding their child’s academic progress and must be informed
   26  of ways they can help their child to succeed in school. K-12
   27  students and their parents are afforded numerous statutory
   28  rights including, but not limited to, the following:
   29         (3) HEALTH ISSUES.—
   30         (q) Anaphylaxis policy.—
   31         1. Each district school board and charter school governing
   32  board shall require each school that serves students in
   33  kindergarten through grade 8 to provide training to an adequate
   34  number of school personnel and contracted personnel in
   35  preventing and responding to allergic reactions, including
   36  anaphylaxis. This training must include recognizing the signs of
   37  an anaphylactic reaction and administering an FDA-approved
   38  epinephrine delivery device that has a pre-measured, appropriate
   39  weight-based dose. Each district school board and charter school
   40  governing board shall also require that, for each student in
   41  kindergarten through grade 8 who has an emergency action plan
   42  for anaphylaxis, such plan must be in effect and accessible at
   43  all times when the student is on school grounds during the
   44  school day or participating in school-sponsored activities. This
   45  includes extracurricular activities, athletics, school dances,
   46  and contracted before-school or after-school programs at the
   47  student’s school.
   48         2. The State Board of Education, in consultation with the
   49  Department of Health, shall adopt rules to implement this
   50  paragraph, including identifying an approved training
   51  curriculum, by October 1, 2025.
   52         Section 2. This act shall take effect July 1, 2025.
