26  SECTION 1. REGULAR SALARIES - ARKANSAS SCHOOL FOR THE BLIND. There is

27 hereby established for the Department of Education - Arkansas School for the

28 Blind for the 2025-2026 fiscal year, the following maximum number of regular

29 employees.

27  SECTION 2. EXTRA HELP - ARKANSAS SCHOOL FOR THE BLIND. There is hereby

28 authorized, for the Department of Education - Arkansas School for the Blind

29 for the 2025-2026 fiscal year, the following maximum number of part-time or

30 temporary employees, to be known as "Extra Help", payable from funds

31 appropriated herein for such purposes: seventeen (17) temporary or part-time

32 employees, when needed, at rates of pay not to exceed those provided in the

33 Uniform Classification and Compensation Act, or its successor, or this act

34 for the appropriate classification.

31       SECTION 13. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS

33 ARKANSAS SCHOOL FOR THE BLIND - TRANSFER PROVISION. Upon approval from the

34 Chief Fiscal Officer of the State, the Arkansas School for the Blind shall

35 transfer appropriation from the Summer Projects line item, in the State

36 Operations Appropriation of this Act, to the Regular Salaries, Extra Help,

1 Personal Services Matching, Overtime and Maintenance & General Operations

2 line items in the State Operations Appropriation of this Act, to compensate

3 staff who work during the summer months on summer projects, and to cover

4 other expenses of summer project activities. The Summer Projects line item

5 may also be used for the annual cost related to the compensation of eligible

6 staff for shift differential pay as well as compensation of employees for

7 performance of duties assigned as referenced in the Special Allowance Special

8 Language Section of this Act. Such additional compensation shall not be

9 construed as exceeding the maximum salary authorized for said employees.

10  The provisions of this section shall be in effect only from July 1, 2024

11 2025 through June 30, 2025 2026.

13  SECTION 14. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS

14 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.

15 ADE - ASB/ASD - SUMMER SCHOOL EMPLOYEES. Employees who, in addition to

16 working during the regular school term, also work during summer months shall

17 be authorized as additional compensation an amount not to exceed 1/12 of

18 their annual salary for each month or part thereof worked. Such additional

19 compensation shall not be construed as exceeding the maximum salary

20 authorized for said employees. Payment of additional compensation shall be

21 limited to employees in the following classifications:

33  Exempt employees who require job responsibilities less than 2080 hours may

34 work during summer months with approval from school Superintendent. Said

35 employees shall be authorized as additional compensation an amount not to

36 exceed 1/12 of their annual salary for each month or part thereof worked.

6   SECTION 15. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS

7 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.

8 CARRY FORWARD OF FUNDS - ASB.

9   (a) The Chief Fiscal Officer of the State shall cause to be

10 transferred on his or her books and those of the State Treasurer and Auditor

11 of State the balance of General Revenue funds remaining in the School for the

12 Blind Fund Account on June 30, 2024 2025 into a sub-fund created within the

13 School for the Blind Fund Account to be used for special maintenance,

14 renovations, or future construction projects of the Department of Education -

15 Arkansas School for the Blind.

16  (b) Any carry forward of the unexpended balance of funding as

17 authorized herein, may be carried forward under the following conditions:

18  (1) The Office of Budget of the Department of Finance and

19 Administration shall report to the Legislative Council all amounts carried

20 forward by the September meeting of the Legislative Council or the Joint

21 Budget Committee meeting which report shall include the name of the agency,

22 board, commission, or institution and the amount of funding carried forward,

23 the program name or line item and the funding source; and

24  (2) The Department of Education - Arkansas School for the Blind

25 shall provide a written report to the Legislative Council or Joint Budget

26 Committee containing all information set forth in subdivision (b)(1) of this

27 section no later than thirty (30) days prior to the time the Department

28 presents its budget request to the Legislative Council or Joint Budget

29 Committee, or both; and

30  (3) Thereupon, the Department of Finance and Administration shall

31 include all information obtained in subdivision (b)(2) of this section in the

32 budget manuals.

33  The provisions of this section shall be in effect only from July 1,

34 2024 2025 through June 30, 2025 2026.

36  SECTION 16. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS

1 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.

2 ARKANSAS SCHOOL FOR THE DEAF - TRANSFER PROVISION. Upon approval from the

3 Chief Fiscal Officer of the State, the Arkansas School for the Deaf shall

4 transfer appropriation from the Miscellaneous Activities line item in the

5 State Operations Appropriation of this Act, to the Regular Salaries, Extra

6 Help, Personal Service Matching, Overtime, and Maintenance and General

7 Operations line items also in the State Operations Appropriation, to

8 compensate staff who work during the summer months on summer projects and to

9 cover other expenses of summer project activities. The Miscellaneous

10 Activities line item may also be used for the annual cost related to the

11 payment of contracted interpreter services, compensation of eligible staff

12 for shift differential pay, and compensation of employees for performance of

13 duties assigned as referenced in the Special Allowance Special Language of

14 this Act. Such additional compensation shall not be construed as exceeding

15 the maximum salary authorized for said employees.

16  The provisions of this section shall be in effect only from July 1, 2024

19  SECTION 17. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS

20 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.

21 CARRY FORWARD OF FUNDS - ASD.

22  (a) The Chief Fiscal Officer of the State shall cause to be

23 transferred on his or her books and those of the State Treasurer and Auditor

24 of State the balance of General Revenue funds remaining in the School for the

25 Deaf Fund Account on June 30, 2024 2025 into a sub-fund created within the

26 School for the Deaf Fund Account to be used for special maintenance,

27 renovations, or future construction projects of the Department of Education -

28 Arkansas School for the Deaf.

29  (b) Any carry forward of the unexpended balance of funding as

30 authorized herein, may be carried forward under the following conditions:

31  (1) The Office of Budget of the Department of Finance and

32 Administration shall report to the Legislative Council all amounts carried

33 forward by the September meeting of the Legislative Council or the Joint

34 Budget Committee meeting which report shall include the name of the agency,

35 board, commission, or institution and the amount of funding carried forward,

36 the program name or line item and the funding source; and

1   (2) The Department of Education - Arkansas School for the Deaf

2 shall provide a written report to the Legislative Council or Joint Budget

3 Committee containing all information set forth in subdivision (b)(1) of this

4 section no later than thirty (30) days prior to the time the Department

5 presents its budget request to the Legislative Council or Joint Budget

6 Committee, or both; and

7   (3) Thereupon, the Department of Finance and Administration shall

8 include all information obtained in subdivision (b)(2) of this section in the

9 budget manuals.

10  The provisions of this section shall be in effect only from July 1,

11 2024 2025 through June 30, 2025 2026.

13  SECTION 18. COMPLIANCE WITH OTHER LAWS. Disbursement of funds

14 authorized by this act shall be limited to the appropriation for such agency

15 and funds made available by law for the support of such appropriations; and

16 the restrictions of the State Procurement Law, the General Accounting and

17 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary

18 Procedures and Restrictions Act, or their successors, and other fiscal

19 control laws of this State, where applicable, and regulations promulgated by

20 the Department of Finance and Administration, as authorized by law, shall be

21 strictly complied with in disbursement of said funds.

23  SECTION 19. LEGISLATIVE INTENT. It is the intent of the General

24 Assembly that any funds disbursed under the authority of the appropriations

25 contained in this act shall be in compliance with the stated reasons for

26 which this act was adopted, as evidenced by the Agency Requests, Executive

27 Recommendations and Legislative Recommendations contained in the budget

28 manuals prepared by the Department of Finance and Administration, letters, or

29 summarized oral testimony in the official minutes of the Arkansas Legislative

30 Council or Joint Budget Committee which relate to its passage and adoption.

32  SECTION 20. EMERGENCY CLAUSE. It is found and determined by the

33 General Assembly, that the Constitution of the State of Arkansas prohibits

34 the appropriation of funds for more than a one (1) year period; that the

35 effectiveness of this Act on July 1, 2025 is essential to the operation of

36 the agency for which the appropriations in this Act are provided, and that in

1 the event of an extension of the legislative session, the delay in the

2 effective date of this Act beyond July 1, 2025 could work irreparable harm

3 upon the proper administration and provision of essential governmental

4 programs. Therefore, an emergency is hereby declared to exist and this Act

5 being necessary for the immediate preservation of the public peace, health

6 and safety shall be in full force and effect from and after July 1, 2025.
