10  CRIMINAL BACKGROUND CHECKS; TO PROHIBIT THE

11  DISQUALIFICATION OF AN OCCUPATIONAL LICENSE BASED ON

12  A PRIOR CONVICTION OF AN OFFENSE IN CERTAIN

13  CIRCUMSTANCES; AND FOR OTHER PURPOSES.

17                       TO AMEND THE LAW CONCERNING OCCUPATIONAL

18                       AND CRIMINAL BACKGROUND CHECKS; AND TO

19                       PROHIBIT THE DISQUALIFICATION OF AN

20                       OCCUPATIONAL LICENSE BASED ON A PRIOR

21                       CONVICTION OF AN OFFENSE IN CERTAIN

22                       CIRCUMSTANCES

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26  SECTION 1. Arkansas Code Title 17, Chapter 3 is amended to add an

27 additional section to read as follows:

28  17-3-105. Prohibited disqualification from licensure.

29  An individual shall not be disqualified from pursuing, practicing, or

30 engaging in any occupation or profession for which licensure is required

31 solely or in part because of a prior conviction of a crime, unless the crime

32 for which the individual was convicted directly relates to the duties and

33 responsibilities of the occupation or profession.
