9   AN ACT TO AMEND THE FOOD, DRUG, AND COSMETIC ACT; TO

10  REQUIRE WARNING LABELS FOR HAIR RELAXERS THAT CONTAIN

11  CERTAIN CHEMICALS; AND FOR OTHER PURPOSES.

17                       HAIR RELAXERS THAT CONTAIN CERTAIN

18                       CHEMICALS.

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21

22  SECTION 1. Arkansas Code Title 20, Chapter 56, Subchapter 2, is

23 amended to add an additional section to read as follows:

24  20-56-224. Labeling of hair relaxers -- Legislative findings --

25 Definitions.

26  (a) The General Assembly finds that certain chemicals used in hair

27 relaxers are linked to harmful impacts on health, such as cancer, birth

28 defects, damage to the reproductive system, organ system toxicity, and

29 endocrine disruption.

30  (b) As used in this section:

31  (1) Carcinogen" means any chemical identified as:

32                       (A) A "Group 1 carcinogen" or "Group 2A carcinogen" by the

33 World Health Organization or International Agency for Research on Cancer;

34                       (B) A "known to be a human carcinogen" and "reasonably

35 anticipated to be a human carcinogen" by the Secretary of the United States

36 Department of Health and Human Services under the Public Health Service Act,

1 42 U.S.C. � 241(b)(4), existing on January 1, 2025; and

2   (C) "Group A carcinogens" or "Group B carcinogens" by the

3 United States Environmental Protection Agency;

4   (2) "Hair relaxer" means any product topically applied to hair

5 for the purpose of weakening the structure and curliness of the hair fiber

6 and allowing for a straightening of the hair; and

7   (3) "Reproductive toxicant" means any chemical identified as a

8 reproductive or a developmental toxicant by the United States Department of

9 Health and Human Services, National Toxicology Program, Center for the

10 Evaluation of Risks to Human Reproduction.

11  (c)(1) A hair relaxer being offered for sale in this state that

12 contains a carcinogen or a reproductive toxicant shall provide a clear and

13 conspicuous warning label displayed on the packaging or product itself, which

14 shall be printed in type no less than size twelve-point font, that notifies

15 the consumer at the time of the sale that the hair relaxer contains a

16 carcinogen or reproductive toxicant.

17  (2) The warning label shall state:

18  (A) If a product contains a carcinogen: "This product

19 contains a chemical known to cause cancer";

20  (B) If a product contains a reproductive toxicant: "This

21 product contains a chemical known to cause birth defects or other

22 reproductive harm"; or

23  (C) If a product contains both a carcinogen and a

24 reproductive toxicant: "This product contains chemicals known to cause cancer

25 and birth defects or other reproductive harm".
