9             AN ACT TO REMOVE THE PROHIBITION ON A TIRE RETAILER

10            FROM CHARGING OTHER FEES TO A PERSON WHO PURCHASES

11            THE SERVICE OF REMOVAL OF A TIRE FROM A RIM; AND FOR

12            OTHER PURPOSES.

18                       PERSON WHO PURCHASES THE SERVICE OF

19                       REMOVAL OF A TIRE FROM A RIM.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22

23  SECTION 1. Arkansas Code � 8-9-404(a)(3)(B), concerning the rim

24 removal fee within the Used Tire Recycling and Accountability Act, is

25 repealed.

26                       (B) Except for the rim removal fees imposed under this

27 section, a tire retailer shall not charge any other fee to a person who

28 purchases the service of removal of a tire from a rim.

30  SECTION 2. Arkansas Code � 8-9-404(e), concerning rim removal fees and

31 commercial generator fees within the Used Tire Recycling and Accountability

32 Act, is amended to read as follows:

33  (e)(1) It is the purpose and intent of this section that only one (1)

34 of the following fees imposed under this section be charged for the

35 transaction of removing a tire from a rim that is related to the sale of a

36 replacement tire:

1   (A) The rim removal fee; or

2   (B) The commercial generator fee.

3   (2) If a person establishes that he or she has paid one (1) of

4 the fees for a tire, the tire retailer or tire generator shall not charge an

5 additional fee for that tire.
