9   AN ACT TO AMEND THE LAW CONCERNING HIGHER EDUCATION;

10  TO AMEND THE LAW RELATED TO THE PROPERTY AND FINANCES

11  OF STATE INSTITUTIONS; TO AMEND THE LAW RELATED TO

12  BONDS; TO AMEND THE LAW REGARDING RENTS, TOLLS, FEES,

13  AND OTHER CHARGES RELATED TO ATHLETIC CONTESTS; AND

14  FOR OTHER PURPOSES.

19                       AND FINANCES OF STATE INSTITUTIONS OF

20                       HIGHER EDUCATION; TO AMEND THE LAW

21                       RELATED TO BONDS; AND TO AMEND THE LAW

22                       REGARDING RENTS, TOLLS, FEES, AND OTHER

23                       CHARGES RELATED TO ATHLETIC CONTESTS.

25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

27  SECTION 1. Arkansas Code � 6-62-302(a), concerning the authority of

28 the boards of trustees of the University of Arkansas, Arkansas State

29 University system, University of Central Arkansas, Henderson State

30 University, Arkansas Tech University, and Southern Arkansas University, is

31 amended to read as follows:

32  (a) Subject to and in accordance with the terms of this subchapter,

33 the boards of trustees of the University of Arkansas, Arkansas State

34 University system, University of Central Arkansas, Henderson State

35 University, Arkansas Tech University, and Southern Arkansas University,

36 respectively, are authorized and empowered as public agencies of the State of

1 Arkansas to:

2         (1) Construct buildings, structures, parking facilities, or

3 other improvements which the board of trustees deems proper or suitable for

4 the school and to purchase sites therefor, if necessary;

5         (2) Purchase for such purpose buildings already constructed and

6 the tracts of land on which they are situated;

7         (3) Reconstruct, enlarge or repair, and equip any buildings or

8 structures of the university, including, but not limited to, buildings or

9 structures constructed or purchased under authority of this subchapter; and

10        (4) Purchase for such purposes and pay the expense of tearing

11 down, removing to the school, reconstructing, and equipping houses,

12 buildings, or structures; and

13        (5) Acquire, improve, install, license, lease, or equip other

14 facilities, improvements, leaseholds, infrastructure, technologies, or any

15 other tangible or intangible properties that the board of trustees deems

16 proper or suitable for the school.

18        SECTION 2. Arkansas Code � 6-62-305(a), concerning the authorization

19 of the board of trustees to issue negotiable interest bearing notes or bonds,

20 is amended to add an additional subdivision to read as follows:

21        (6) Any other revenues derived from the operation of the board

22 and the campuses governed thereby, excluding any moneys that are derived from

23 tax collections.

25        SECTION 3. Arkansas Code � 6-62-311 is amended to read as follows:

26        6-62-311. Rents, tolls, fees, etc. -- Rules authorized.

27        A board of trustees is further authorized and empowered to fix the

28 rents, tolls, fees, other charges, activity fees, and gate receipts of

29 athletic contests and to make and to enforce the rules with reference to or

30 in connection with any building, or structure, facility, improvement,

31 infrastructure, leasehold, technology, or property authorized to be

32 constructed, reconstructed, enlarged, repaired, improved, installed,

33 licensed, leased, or equipped and with reference to the use thereof as the

34 board may deem desirable for the welfare of the institution or its student

35 body.
