18 PIECE OF MACHINERY; AND TO AMEND THE LAW
19 CONCERNING THE RELEASE OF A VEHICLE THAT
20 HAS BEEN TOWED OR STORED.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code � 27-50-1101(a)(3), concerning the
25 nonconsensual towing of a vehicle, implement, or piece of machinery, is
26 amended to add an additional subdivision to read as follows:
27 (D)(i) If the owner of a vehicle, implement, or piece of
28 machinery removed under this section has not consented to the towing or
29 storage of the vehicle, implement, or piece of machinery, the towing and
30 storage company shall release the vehicle, implement, or piece of machinery
31 to the owner or the owner's representative, notwithstanding the failure of
32 the owner to satisfy the possessory lien held by the towing and storage
33 company or a county, city of the first class, city of the second class, or
34 incorporated town under � 27-50-1208 or under subdivision (a)(3)(A) -- (C) of
35 this section.
36 (ii)(a) The owner of a vehicle, implement, or piece

1 of machinery released under subdivision (a)(3)(D)(i) of this section shall
2 not sell the vehicle, implement, or piece of machinery without satisfying the
3 former possessory lien under � 27-50-1208 or under subdivisions (a)(3)(A) --
4 (C) of this section.
5 (b) A violation of subdivision
6 (a)(3)(D)(ii)(a) of this section is a Class C misdemeanor.
7 (c) In addition to the penalty provided in
8 subdivision (a)(3)(D)(ii)(b) of this section, a person who violates
9 subdivision (a)(3)(D)(ii)(a) of this section upon conviction shall be ordered
10 by the court to pay twice the amount of the possessory lien on the vehicle,
11 implement, or piece of equipment to the lien holder.
