12 DRIVER'S LICENSE OR IMPOSITION OF RESTRICTIONS ON A
13 DRIVER'S LICENSE OF A PERSON WHO HAS SUFFERED A
14 SEIZURE; AND FOR OTHER PURPOSES.

19 A DRIVER'S LICENSE OR IMPOSITION OF
20 RESTRICTIONS ON A DRIVER'S LICENSE OF A
21 PERSON WHO HAS SUFFERED A SEIZURE.

23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25 SECTION 1. DO NOT CODIFY. Legislative findings and intent.
26 (a) The General Assembly finds that:
27 (1) A 2025 position statement from the American Academy of
28 Neurology endorsed a three-month seizure-free period for drivers with
29 seizures;
30 (2) Seizures are a common occurrence, affecting between nine
31 percent (9%) and ten percent (10%) of the population over the course of a
32 person's lifetime; and
33 (3) Driving is highly regulated for people with epilepsy,
34 compromising their independence, ability to work, and ability to maintain
35 relationships, despite the fact that epilepsy-related car crashes constitute
36 only two-tenths of one percent (0.2%) of car crashes in the United States

1 compared to the four percent (4%) of car crashes related to cardiovascular
2 disease and thirty percent (30%) of car crashes related to alcohol.
3 (b) The General Assembly intends for this act to align Arkansas
4 driving laws with the American Academy of Neurology's recommendations and the
5 majority of other states regarding the operation of a motor vehicle by a
6 person who has previously suffered a seizure.

8 SECTION 2. Arkansas Code � 27-16-909(b), concerning the suspension or
9 revocation of a driver's license for the inability to drive, is amended to
10 add an additional subdivision to read as follows:
11 (b)(1) Upon receipt by the Office of Driver Services of evaluations
12 required under subsection (a) of this section, the Office of Driver Services
13 may suspend or revoke the license of the person or may permit the person to
14 retain his or her license or may issue a license subject to restrictions as
15 permitted under � 27-16-804.
16 (2) If the Office of Driver Services requires a licensee to
17 submit to an evaluation under subsection (a) of this section because the
18 person suffered a seizure, the Office of Driver Services shall not suspend or
19 revoke the license of the person or impose a restriction on the driver's
20 license of the person for a period greater than six (6) months from the date
21 that he or she last experienced a seizure regardless of whether the person is
22 on medication.
