9   AN ACT TO AMEND THE LAW CONCERNING THE UNLAWFUL

10  POSSESSION OF A SKIMMER; TO INCREASE PENALTIES FOR

11  THE UNLAWFUL POSSESSION OF A SKIMMER FOR REPEAT

12  OFFENDERS; AND FOR OTHER PURPOSES.

16                       TO AMEND THE LAW CONCERNING THE UNLAWFUL

17                       POSSESSION OF A SKIMMER; AND TO INCREASE

18                       PENALTIES FOR THE UNLAWFUL POSSESSION OF

19                       A SKIMMER FOR REPEAT OFFENDERS.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23  SECTION 1. Arkansas Code � 5-37-219(c), concerning the penalty for

24 unlawful possession of a skimmer, is amended to read as follows:

25  (c)(1) Unlawful possession of a skimmer is a Class C felony.

26  (2) A second or subsequent conviction under this section is an

27 unclassified felony with a mandatory fine of not more than twenty thousand

28 dollars ($20,000) and a mandatory term of imprisonment of at least one (1)

29 year but not more than ten (10) years.
