9               AN ACT TO REQUIRE THE ARKANSAS MEDICAID PROGRAM TO

10              COVER APPLIED BEHAVIOR ANALYSIS SERVICES FOR CERTAIN

11              BENEFICIARIES; AND FOR OTHER PURPOSES.

17                       SERVICES FOR CERTAIN BENEFICIARIES.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

20

21  SECTION 1. Arkansas Code Title 20, Chapter 77, Subchapter 1, is

22 amended to add an additional section to read as follows:

23  20-77-154. Applied behavior analysis services.

24  (a) The Arkansas Medicaid Program shall cover applied behavior

25 analysis services for beneficiaries who:

26              (1) Are over twenty-one (21) years of age;

27              (2) Have a diagnosis of autism;

28              (3) Are participants in the Community and Employment Services

29 Waiver; and

30              (4) Have received a determination from a primary care physician,

31 attending psychologist, or psychiatrist that applied behavior analysis

32 services are medically necessary.

33  (b) The applied behavior analysis services shall be delivered:

34              (1) Based on the needs of the beneficiary, including applied

35 behavior analysis services on a one-to-one basis at home and in the

36 community; and

1   (2) By a board certified behavior analyst or a registered

2 behavior technician who is under the supervision of a board certified

3 behavior analyst.

4   (c) The applied behavior analysis services shall not be limited or

5 restricted to group and clinical settings.

6   (d) The Department of Human Services shall apply for any federal

7 waiver, Medicaid state plan amendment, or other authorization necessary to

8 implement this section.
