9   AN ACT TO AMEND THE LAW ON THE DESTRUCTION OR

10  EXPUNGEMENT OF JUVENILE DELINQUENCY RECORDS; AND FOR

11  OTHER PURPOSES.

16                       EXPUNGEMENT OF JUVENILE DELINQUENCY

17                       RECORDS.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21  SECTION 1. Arkansas Code � 9-27-309(b), concerning expungement of

22 delinquency adjudications under the Arkansas Juvenile Code of 1989, is

23 amended to read as follows:

24  (b)(1)(A) Records of delinquency adjudications for a felony involving

25 violence as defined under � 5-4-501 shall be kept for ten (10) years after

26 the last adjudication of delinquency or the date of a plea of guilty or nolo

27 contendere or a finding of guilt as an adult.

28                       (B) Thereafter they may be expunged.

29  (2) Records of all other delinquency adjudications shall be

30 expunged upon the individual's twenty-first birthday.

31  (2)(3) The court may expunge other juvenile records at any time

32 and shall expunge all the records of a juvenile upon his or her twenty-first

33 birthday, in other types of delinquency, dependency-neglect, or families in

34 need of services cases.

35  (3)(4) For purposes of this section, "expunge" means to destroy

36 seal as defined in � 16-90-1404.
