9   AN ACT CONCERNING THE ADMINISTRATION OF A STATEWIDE

10  STUDENT ASSESSMENT TO A STUDENT IN A VIRTUAL SETTING;

11  TO REQUIRE AN ADULT APPROVED TO OVERSEE THE

12  ADMINISTRATION OF A STATEWIDE STUDENT ASSESSMENT TO

13  CERTAIN STUDENTS IN A VIRTUAL SETTING TO MEET CERTAIN

14  REQUIREMENTS; AND FOR OTHER PURPOSES.

20                       STUDENT ASSESSMENT TO CERTAIN STUDENTS

21                       IN A VIRTUAL SETTING TO MEET CERTAIN

22                       REQUIREMENTS.

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26  SECTION 1. Arkansas Code � 6-18-114(b)(5), concerning requirements a

27 public school that operates primarily as a virtual school and that

28 administers a statewide student assessment to a student in a virtual setting

29 must meet, is amended to read as follows:

30  (5)(A) An adult approved in accordance with terms established by

31 the public school that primarily operates as a virtual school and is

32 administering a statewide student assessment to a student in kindergarten

33 through grade eight (K-8) in a virtual setting, including without limitation

34 the student's parent, legal guardian, or person standing in loco parentis to

35 the student, is physically present with the student for the duration of the

36 administration of the statewide student assessment.

1   (B) An adult approved in accordance with terms established

2 by the public school that primarily operates as a virtual school and

3 administering a statewide student assessment to a student in grades nine

4 through twelve (9-12) in a virtual setting, including without limitation the

5 student's parent, legal guardian, or person standing in loco parentis to the

6 student, shall attest prior to the administration of an assessment to the

7 student in a virtual setting that the student and the approved adult shall

8 adhere to all current testing security protocols;
