10  BAN FROM COACHING A COACH OR AN ATHLETICS PERSONNEL

11  MEMBER WHO RECRUITS A STUDENT; AND FOR OTHER

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22  SECTION 1. Arkansas Code Title 6, Chapter 17, Subchapter 1, is amended

23 to add an additional section to read as follows:

24  6-17-125. Recruitment -- Prohibitions -- Definitions.

25  (a) As used in this section:

26  (1) "Athletics personnel" means athletic directors and other

27 individuals actively involved in organizing, training, or coaching athletic

28 events for student athletes;

29  (2) "Recruit" means the use of undue influence or special

30 inducement by a coach or an athletics personnel member employed by a school

31 that is a member of the Arkansas Activities Association in an attempt to

32 encourage, induce, pressure, urge, or entice a prospective student of any age

33 to transfer to the school or retain a student at the school for the purpose

34 of participating in extracurricular activities; and

35  (3) "School" means a public school district or an open-

36 enrollment public charter school.

1   (b) A coach or an athletics personnel member who is employed by a

2 school and is found by the Arkansas Activities Association to have recruited

3 a student to the school at which he or she is employed shall be permanently

4 banned from employment as a coach or an athletics personnel member at a

5 school in this state.
