22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code Title 21, Chapter 8, Subchapter 1, is amended
25 to add an additional section to read as follows:
26 21-8-105. Disclosure by former state employees and former elected
27 officials � Definitions.
28 (a) As used in this section:
29 (1) "Former elected official" includes without limitation a
30 person previously elected to the following offices:
31 (A) Governor;
32 (B) Lieutenant Governor;
33 (C) Secretary of State;
34 (D) Attorney General;
35 (E) Treasurer of State;
36 (F) Auditor of State;

1 (G) Commissioner of State Lands; or
2 (H) Member of the General Assembly;
3 (2) "Former state employee" means a person who was previously
4 regularly appointed or employed in a position of state service by a state
5 agency, for which he or she was compensated on a full-time or part-time
6 basis; and
7 (3) "State agency" means every department, division, office,
8 board, commission, and institution of this state, including state-supported
9 institutions of higher education.
10 (b)(1) For a period of four (4) years from the end of his or her
11 employment or his or her term of elected office, a former state employee or
12 former elected official shall disclose the following activities to the
13 Arkansas Ethics Commission:
14 (A) Knowingly entering into employment with an individual,
15 business, or other entity that was awarded a contract by his or her state
16 agency or elected office during his or her employment or his or her term of
17 elected office; or
18 (B) Knowingly selling a good or commodity to an
19 individual, business, or other entity that was awarded a contract by his or
20 her state agency or elected office during his or her employment or his or her
21 term of elected office.
22 (2) The disclosure under subdivision (b)(1) of this section
23 shall be filed within thirty (30) days of the employment or sale.
24 (3) Once the initial disclosure is filed under subdivision
25 (b)(2) of this section, the former state employee or former elected official
26 shall file a disclosure quarterly until he or she:
27 (A) Is no longer knowingly employed with an individual,
28 business, or other entity that was awarded a contract by his or her state
29 agency or elected office during his or her employment or his or her term of
30 elected office;
31 (B) Is no longer knowingly selling a good or commodity to
32 an individual, business, or other entity that was awarded a contract by his
33 or her state agency or elected office during his or her employment or his or
34 her term of elected office; or
35 (C) Has been a former state employee or former elected
36 official for a period of more than four (4) years from the end of his or her

1 employment or his or her term of elected office.
2 (c) The commission shall promulgate rules to implement this section,
3 including without limitation a rule creating the form for the disclosure
4 required under subsection (b) of this section.
5 (d) This section expires on June 30, 2029, unless extended by the
6 General Assembly.
