9   AN ACT TO AMEND THE FREEDOM OF INFORMATION ACT OF

10  1967; TO AMEND THE LAW CONCERNING PUBLIC MEETINGS

11  UNDER THE FREEDOM OF INFORMATION ACT OF 1967; AND FOR

12  OTHER PURPOSES.

16                       TO AMEND THE FREEDOM OF INFORMATION ACT

17                       OF 1967; AND TO AMEND THE LAW CONCERNING

18                       PUBLIC MEETINGS UNDER THE FREEDOM OF

19                       INFORMATION ACT OF 1967.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22

23  SECTION 1. Arkansas Code � 25-19-103(6), concerning the

24 definition of "public meeting" under the Freedom of Information Act of 1967,

25 is amended to read as follows:

26  (6) "Public meetings" means the meetings of more than two (2)

27 members of any bureau, commission, or agency of the state or any political

28 subdivision of the state, including municipalities and counties, boards of

29 education, and all other boards, bureaus, commissions, or organizations in

30 the State of Arkansas, except grand juries, supported wholly or in part by

31 public funds or expending public funds;

33  SECTION 2. Arkansas Code � 25-19-106(a), concerning public meetings

34 under the Freedom of Information Act of 1967, is amended to read as follows:

35  (a)(1) Except as otherwise specifically provided by law, all meetings,

36 formal or informal, special or regular, of more than two (2) members of the

1 governing bodies of all municipalities, counties, townships, and school

2 districts and all boards, bureaus, commissions, or organizations of the State

3 of Arkansas, except grand juries, supported wholly or in part by public funds

4 or expending public funds, shall be public meetings.

5   (2) If two (2) members of a governing body discuss a matter upon

6 which action may be taken by the governing body outside of a public meeting

7 of the governing body, the two (2) members of the governing body are

8 prohibited from disclosing the opinion or position of another member on the

9 matter with other members of the governing body.
