23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25 SECTION 1. Arkansas Code Title 12, Chapter 12, Subchapter 1, is
26 amended to add an additional section to read as follows:
27 12-8-130. Missing endangered child advisory system.
28 (a) There is established a standardized system to aid in the search of
29 missing children who do not meet the criteria for activation of the Arkansas
30 Amber Alert System.
31 (b) The Division of Arkansas State Police shall operate the missing
32 endangered child advisory system created by this section.
33 (c) The missing endangered child advisory system shall be activated
34 for a child under eighteen (18) years of age under the following
35 circumstances:
36 (1) When the disappearance of the child appears to be

1 unexplained, involuntary, or suspicious;
2 (2) When it is suspected but not confirmed that the child was
3 abducted;
4 (3) When the child has been diagnosed with a:
5 (A) Developmental disability or pervasive developmental
6 disorder; or
7 (B) Physical, mental, or cognitive impairment; or
8 (4) When the child may otherwise be in danger due to age,
9 health, weather conditions, presence with a potentially dangerous person, or
10 other circumstance.
11 (d) The Division of Arkansas State Police shall:
12 (1) Establish the procedure for activation of the missing
13 endangered child advisory system; and
14 (2) Coordinate with local law enforcement to ensure the
15 effective use of the missing endangered child advisory system.
16 (e) The missing endangered child advisory system shall only be
17 activated when the missing child's disappearance does not qualify for the
18 activation of the Arkansas Amber Alert System.
