25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

27 SECTION 1. Arkansas Code � 23-99-422(a)(2), concerning the definition
28 of "psychiatric collaborative care model" under the Arkansas Health Care
29 Consumer Act, is amended to read as follows:
30 (2) "Psychiatric collaborative care model" means the delivery of
31 care that is:
32 (A) An evidence-based, integrated behavioral health
33 service delivery method described at 81 Fed. Reg. 80230-80239, as it existed
34 on March 31, 2023 January 1, 2025, and the MLN Booklet for Behavioral Health
35 Integration Services published by the Centers for Medicare & Medicaid
36 Services, as it existed on March 31, 2023 January 1, 2025; and

1 (B)(i) A method typically used by a primary care team
2 consisting of a primary care provider and a care manager who works in
3 collaboration with a psychiatric consultant, including without limitation a
4 psychiatrist.
5 (ii)(a) A primary care team under subdivision
6 (a)(2)(B)(i) of this section may include an individual providing clinical
7 psychiatric pharmacist services if the individual:
8 (1) Possesses a pharmacy degree
9 from a program accredited by the Accreditation Council for Pharmacy
10 Education;
11 (2) Utilizes a protocol of disease
12 state management as defined under � 17-92-101 with a supervising provider or
13 provides independent services as a consultant with drug information and
14 medication therapy expertise; and
15 (3) Holds his or her pharmacist
16 license in good standing with the Arkansas State Board of Pharmacy.
17 (b) An individual providing clinical
18 psychiatric pharmacist services may hold a national board certification.
