10 SEALING ACT OF 2013; TO PERMIT THE FILING OF A NEW
11 UNIFORM PETITION TO SEAL A MISDEMEANOR VIOLATION OF
12 THEFT OF PROPERTY AFTER TEN YEARS HAVE ELAPSED SINCE
13 THE DATE OF THE THEFT OF PROPERTY OFFENSE; AND FOR
14 OTHER PURPOSES.

18 TO AMEND THE COMPREHENSIVE CRIMINAL
19 RECORD SEALING ACT OF 2013; AND TO
20 PERMIT THE FILING OF A NEW UNIFORM
21 PETITION TO SEAL A MISDEMEANOR VIOLATION
22 OF THEFT OF PROPERTY AFTER TEN YEARS
23 HAVE ELAPSED SINCE THE THEFT.

25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

27 SECTION 1. Arkansas Code � 16-90-1405(b), concerning the number of
28 times a person may file a new uniform petition to seal a misdemeanor or
29 violation conviction, is amended to read as follows:
30 (b) There is not a limit to the number of times a person may file a
31 uniform petition to seal his or her record of a misdemeanor or violation,
32 except that the person may not file:
33 (1) A new uniform petition to seal one (1) of the following
34 criminal offenses until after a period of five (5) years has elapsed since
35 the completion of the person's sentence for the conviction:
36 (A) Negligent homicide, � 5-10-105, if it was a Class A

1 misdemeanor;
2 (B) Battery in the third degree, � 5-13-203;
3 (C) Indecent exposure, � 5-14-112;
4 (D) Public sexual indecency, � 5-14-111;
5 (E) Sexual assault in the fourth degree, � 5-14-127; or
6 (F) Domestic battering in the third degree, � 5-26-305;
7 (2) A new uniform petition to seal a misdemeanor violation
8 of driving or boating while intoxicated, � 5-65-103, until after the
9 applicable lookback periods under � 5-65-111 have elapsed;
10 (3) A new uniform petition to seal a criminal offense listed in
11 subdivisions (b)(1)(A)-(F) or subdivision (b)(2) of this section before one
12 (1) year from the date of the order denying the previous uniform petition;
13 (4) A new uniform petition to seal a misdemeanor or violation
14 before ninety (90) days from the date of an order denying a uniform petition
15 to seal the misdemeanor or violation;
16 (5) A new uniform petition to seal a misdemeanor or violation
17 under this section if an appeal of a previous denial of a uniform petition to
18 seal a misdemeanor or violation for the same misdemeanor or violation is
19 still pending; or
20 (6) A new uniform petition to seal a misdemeanor or violation
21 under this section if:
22 (A) The person was a holder of a commercial driver license
23 or commercial learner's permit at the time the misdemeanor or violation was
24 committed; and
25 (B) The misdemeanor or violation was a traffic offense,
26 other than a parking violation, vehicle weight violation, or vehicle defect
27 violation, committed in any type of motor vehicle; or
28 (7) A new uniform petition to seal a misdemeanor violation of
29 theft of property, � 5-36-103, until after a period of ten (10) years has
30 elapsed since the date of the offense.
