9   AN ACT TO AMEND THE REQUIREMENTS REGARDING LOCATIONS

10  FOR AND GEOGRAPHIC AREAS OF A HOSPICE AGENCY; AND FOR

11  OTHER PURPOSES.

16                       LOCATIONS FOR AND GEOGRAPHIC AREAS OF A

17                       HOSPICE AGENCY.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21  SECTION 1. Arkansas Code � 20-8-107(a), concerning the expansion of

22 facilities and services under the Health Services Permit Agency, is amended

23 to read as follows:

24  (a)(1) Unless otherwise provided in this subchapter, all health

25 facilities seeking to add new beds or perform additional home health services

26 or to expand existing bed capacity shall apply for a permit approving

27 additional beds or services or expanded bed capacity or services pursuant to

28 procedures and criteria promulgated by the Health Services Permit Commission,

29 except an additional permit shall not be required for:

30                       (A) Home home health services agencies currently licensed

31 by the Department of Health to expand geographic service areas if the home

32 health services agency has a primary or branch office located within one

33 hundred (100) miles of the location of the services; or

34                       (B) Hospice agencies currently licensed by the Department

35 of Health to expand geographic service areas if the hospice agency has a

36 primary office, satellite office, or alternate delivery site located within

1 one hundred (100) miles of the location of the services.

2           (2) A home health services agency or a hospice agency shall

3 provide notification to the Department of Health and the Health Services

4 Permit Agency forty-five (45) days in advance of adding an office location

5 from which the home health services agency or hospice agency plans to serve

6 within a one-hundred-mile area of the new location.

7           (3) The Department of Health and the Health Services Permit

8 Agency shall record any expansion in service area in its publicly distributed

9 records.

10          (4) A home health service agency or a hospice agency that is

11 providing services outside of a permitted service area shall be subject to

12 appropriate penalties under � 20-7-101 and � 20-10-803.
