9            AN ACT TO AMEND THE LAW CONCERNING THE OPERATION OF

10           AN ALL-TERRAIN VEHICLE ON CERTAIN ROADS; TO AMEND THE

11           LAW CONCERNING THE ACCESS OF ALL-TERRAIN VEHICLES TO

12           UNPAVED ROADS; AND FOR OTHER PURPOSES.

16                       TO AMEND THE LAW CONCERNING THE

17                       OPERATION OF AN ALL-TERRAIN VEHICLE ON

18                       CERTAIN ROADS; AND TO AMEND THE LAW

19                       CONCERNING THE ACCESS OF ALL-TERRAIN

20                       VEHICLES TO UNPAVED ROADS.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23

24  SECTION 1. Arkansas Code � 27-21-102, concerning the definitions to be

25 used in relation to all-terrain vehicles, is amended to add an additional

26 subdivision to read as follows:

27           (5)(A) "Unpaved road" means a public street or highway that is

28 not paved with asphalt, chip-seal, concrete, brick, or stone.

29                       (B) "Unpaved road" includes without limitation a road

30 constructed of:

31                           (i) Dirt; or

32                           (ii) Gravel.

34  SECTION 2. Arkansas Code � 27-21-106(a)(1), concerning the operation

35 of all-terrain vehicles on public streets and highways, is amended to read as

36 follows:

1               (1) A person may operate an all-terrain vehicle on a public

2 street or highway if the all-terrain vehicle is:

3                 (A) Both:

4                           (i) Used in farming or hunting operations; and

5                           (B)(ii) Operated on a public street or highway in

6 order to get from one field to another; or

7                 (B) Operated:

8                           (i) Except as provided in subsection (c) of this

9 section, on a public street or highway that is unpaved; and

10                          (ii) By a person who:

11                              (a) Is a:

12                               (1) Resident of this state who has a

13 valid commercial driver license or noncommercial driver's license issued by

14 this state in his or her immediate possession as required under � 27-16-601;

15 or

16                               (2) Nonresident who is subject to the

17 exemption from the licensing requirements of this state under � 27-16-603(3)

18 or (4); and

19                              (b) Maintains liability insurance on the all-

20 terrain vehicle that provides at a minimum the following coverage:

21                               (i) Not less than twenty-five thousand

22 dollars ($25,000) for bodily injury or death of one (1) person in any one (1)

23 accident; and

24                               (ii) If the accident results in damage

25 to or destruction of property, not less than twenty-five thousand dollars

26 ($25,000) for the damage to or destruction of property of others in any one

27 (1) accident.

29     SECTION 3. Arkansas Code � 27-21-106(a)(3)(A), concerning the

30 operation of an all-terrain vehicle on public streets and highways, is

31 amended to read as follows:

32              (3)(A) A person who has lost one (1) or both legs above the

33 ankle or who otherwise has a serious walking disability is permitted to

34 operate a three-wheeled, four-wheeled, or six-wheeled all-terrain vehicle as

35 a means of transportation on any of the following:

36                          (i) A nonhard-surfaced An unpaved road;

1                           (ii) The shoulder of a state or federal highway,

2 except as provided under subdivision (a)(3)(E) of this section; or

3                           (iii) A public street or road when traveling on the

4 public street or road is the most reasonable route of access available to him

5 or her from one off-road trail to another off-road trail or from his or her

6 private property to an off-road trail.

8   SECTION 4. Arkansas Code � 27-21-106, concerning the operation

9 of an all-terrain vehicle on public streets and highways, is amended to add

10 an additional subsection to read as follows:

11  (c) The quorum court of a county may adopt an ordinance to prohibit

12 the operation of an all-terrain vehicle under subdivision (a)(1)(B) of this

13 section on unpaved roads located in the county by a two-thirds (2/3) vote of

14 the total membership of the quorum court.
