10  PROJECTS; TO AMEND THE DEFINITION OF "PROPERTY IN

11  KIND"; AND FOR OTHER PURPOSES.

17                       DEFINITION OF "PROPERTY IN KIND"; AND

18                       FOR OTHER PURPOSES.

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22  SECTION 1. Arkansas Code � 14-270-102(7), concerning the definition of

23 "property in kind" in relation to rural community projects, is amended to

24 read as follows:

25  (7) "Property in kind" means real or personal property "In-kind

26 donations" means committed goods and services, including without limitation:

27                       (A) Real or personal property;

28                       (B) Labor;

29                       (C) Equipment;

30                       (D) Materials;

31                       (E) Services; and

32                       (F) Money.

34  SECTION 2. Arkansas Code � 14-270-103(a)(2)(A), concerning when the

35 grant of state funds is authorized for rural community projects, is amended

36 to read as follows:

1               (2)(A) The members of the community or small city or town

2 presenting the request to the quorum court or the governing body shall have

3 submitted proof that, through donations of either money or property in kind

4 in-kind donations, the citizens of the community, city, or town, have pledged

5 or will make available one-fourth (�) of the cost of the project and that no

6 tax funds are included in the citizens' support.

8   SECTION 3. Arkansas Code � 14-270-103(a)(3), concerning when the grant

9 of state funds is authorized for rural community projects, is amended to read

10 as follows:

11              (3) The quorum court of the county or governing body of the city

12 or town approves and, if the citizens of the community, city, or town do not

13 provide the county's or the city's or town's share, appropriates the funds or

14 provides property in kind in-kind donations to defray one-fourth (�) of the

15 cost of the project; and
