9   AN ACT TO CREATE THE DEPARTMENT OF FINANCIAL SERVICES

10  WITHIN THE DEPARTMENT OF COMMERCE; AND FOR OTHER

11  PURPOSES.

15                       TO CREATE THE DEPARTMENT OF FINANCIAL

16                       SERVICES WITHIN THE DEPARTMENT OF

17                       COMMERCE.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

20

21  SECTION 1. Arkansas Code Title 23, Chapter 45, Subchapter 1, is

22 amended to add an additional section to read as follows:

23  23-45-107. Department of Financial Services -- Creation.

24  (a) There is created within the Department of Commerce the Department

25 of Financial Services.

26  (b) The Department of Financial Services shall consist of:

27  (1) The State Bank Department; and

28  (2) State Securities Department.

29  (c) The Bank Commissioner shall be the Director of the Department of

30 Financial Services.

32  SECTION 2. Arkansas Code � 25-43-302(a)(21), concerning the state

33 entities within the Department of Commerce, is amended to read as follows:

34  (21) The State Bank Department, created under � 23-46-201,

35 within the Department of Financial Services;

1   SECTION 3. Arkansas Code � 25-43-302(a), concerning the state entities

2 within the Department of Commerce, is amended to add an additional

3 subdivision to read as follows:

4          (26) The Department of Financial Services, created under � 23-

5 45-107.
