9   AN ACT CONCERNING A WAIVER FOR A RENEWED BACKGROUND

10  CHECK GRANTED BY A BOARD OF DIRECTORS OF AN

11  EDUCATIONAL ENTITY TO AN APPLICANT FOR A NONLICENSED

12  STAFF POSITION; AND FOR OTHER PURPOSES.

16                       CONCERNING A WAIVER FOR A RENEWED

17                       BACKGROUND CHECK GRANTED BY A BOARD OF

18                       DIRECTORS OF AN EDUCATIONAL ENTITY TO AN

19                       APPLICANT FOR A NONLICENSED STAFF

20                       POSITION.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24  SECTION 1. Arkansas Code � 6-17-414(g)(5), concerning a waiver of the

25 required background check for a nonlicensed staff position granted by the

26 adoption of a resolution by the board of trustees of an educational entity,

27 is amended to add an additional subdivision to read as follows:

28                       (D) A waiver granted by a board of directors of an

29 educational entity under this subdivision (g)(5) shall be valid for the

30 duration of the applicant's employment with the educational entity only if

31 the applicant does not experience:

32                         (i) A break in employment with the educational

33 entity after receiving the waiver; and

34                         (ii) An additional disqualifying conviction under

35 this section after receiving the waiver.
