9              AN ACT TO REPEAL THE LAW CONCERNING NATURAL ORGANIC

10             FERTILIZERS; AND FOR OTHER PURPOSES.

14                       TO REPEAL THE LAW CONCERNING NATURAL

15                       ORGANIC FERTILIZERS.

17 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

18

19  SECTION 1. Arkansas Code Title 2, Chapter 19, Subchapter 5, is

20 repealed.

21  2-19-501. Definition.

22  "One hundred percent (100%) natural organic fertilizer" shall be

23 defined as and include the following:

24             (1)(A) One hundred percent (100%) organic fertilizer -- Materials

25 derived from either plant or animal products containing one (1) or more

26 elements other than carbon, hydrogen, and oxygen which are essential for

27 plant growth.

28                       (B) These materials may be subjected to biological

29 degradation processes under conditions of drying, composting, enzymatic or

30 anaerobic/aerobic bacterial action or any combination of these.

31                       (C) These materials shall not be mixed with synthetic

32 materials;

33             (2) One hundred percent (100%) natural organic fertilizer shall

34 be processed from only one hundred percent (100%) animal substrate. No other

35 organic or inorganic, natural or synthetic, additives shall be used during

36 processing and no fortification may be used;

1   (3) One hundred percent (100%) natural organic fertilizers shall

2 contain as a guaranteed analysis not less than: nitrogen (N), four percent

3 (4.0%); phosphoric acid (P2O5), two percent (2.0%); and potash (K2O), four

4 percent (4.0%); and

5   (4) Determination of the guaranteed analysis will be according

6 to methods adopted by the AOAC International. (Fertilizers and Materials

7 Containing Large Quantities of Organic Matter; 12th edition, With Following

8 Improvements.).

10  2-19-502. Regulation and supervision -- Fees and penalties -- Guarantee

11 of elements.

12  (a) The State Plant Board shall have the authority to regulate and

13 supervise the manufacture and sale of one hundred percent (100%) natural

14 organic fertilizer, including the setting and collecting of reasonable fees

15 for sampling and analyzing the fertilizer and registering manufacturers, and

16 shall adopt and promulgate such rules and penalties consistent with this

17 subchapter, and � 2-19-202, as may be necessary.

18  (b) The fees and penalties set and collected by the board under this

19 section shall not exceed like fees and penalties set for other types of

20 fertilizers.

21  (c) When any reference or claim is made on the label for secondary or

22 minor plant nutrients, a specific guarantee of the specific elements

23 contained shall be given in the guaranteed analysis.

25  2-19-503. Exemptions.

26  This subchapter shall not affect the private sale of unprocessed animal

27 litter, nor shall the State Plant Board regulate the private sale of

28 unprocessed animal litter which is not sold as one hundred percent (100%)

29 natural organic fertilizer as defined by this subchapter.
