10 IMPROVEMENT APPROPRIATIONS FOR THE SECRETARY OF
11 STATE; AND FOR OTHER PURPOSES.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21 SECTION 1. REAPPROPRIATION - CAPITAL IMPROVEMENT PROJECTS. There is
22 hereby appropriated, to the Secretary of State, to be payable from the
23 Development and Enhancement Fund, for the Secretary of State the following:
24 (A) Effective July 1, 2025, the balance of the appropriation provided
25 in Item (A) of Section 1 of Act 106 of 2024, for replacement of voting
26 machine equipment - statewide, in a sum not to exceed ...........$15,000,000.
27 (B) Effective July 1, 2025, the balance of the appropriation provided
28 in Item (B) of Section 1 of Act 106 of 2024, for HVAC upgrade to North End of
29 State Capitol building, in a sum not to exceed ...................$6,500,000.
30 (C) Effective July 1, 2025, the balance of the appropriation provided
31 in Item (C) of Section 1 of Act 106 of 2024, for roof and window repair of
32 the State Capitol building, in a sum not to exceed ...............$2,500,000.
33 (D) Effective July 1, 2025, the balance of the appropriation provided
34 in Item (D) of Section 1 of Act 106 of 2024, for asphalt resurfacing,
35 replacement of damaged sidewalks and curbs, addition of lighting to unlit or
36 dark areas, an upgrade of the irrigation system, and landscaping and

1 plantings for the North Entry Promenade I & II of the State Capitol Grounds,
2 in a sum not to exceed .............................................$538,112.
3 (E) Effective July 1, 2025, the balance of the appropriation provided
4 in Item (E) of Section 1 of Act 106 of 2024, for drains and storm water
5 system renovations of the State Capitol Grounds, in a sum not to exceed
6 ....................................................................$483,000.
7 (F) Effective July 1, 2025, the balance of the appropriation provided
8 in Item (F) of Section 1 of Act 106 of 2024, for interior plumbing and sump
9 pump replacement for the State Capitol building, in a sum not to exceed
10 ....................................................................$108,393.
11 (G) Effective July 1, 2025, the balance of the appropriation provided
12 in Item (G) of Section 1 of Act 106 of 2024, for electrical panel replacement
13 in the State Capitol building, in a sum not to exceed ..............$212,980.
14 (H) Effective July 1, 2025, the balance of the appropriation provided
15 in Item (H) of Section 1 of Act 106 of 2024, for expenses for State Capitol
16 as-built drawings, in a sum not to exceed ..........................$250,000.
17 (I) Effective July 1, 2025, the balance of the appropriation provided
18 in Item (I) of Section 1 of Act 106 of 2024, for "Green" Initiatives for the
19 State Capitol building, facilities and grounds including ventilation system
20 cleaning, energy efficiency improvements and assessment, analysis and
21 consulting services, recycling programs and/or related construction,
22 renovation and equipping of and/or conversion to or purchase of Compressed
23 Natural Gas vehicles and equipment including installation of a refueling
24 station, in a sum not to exceed...................................$1,500,000.
25 (J) Effective July 1, 2025, the balance of the appropriation provided
26 in Item (J) of Section 1 of Act 106 of 2024, for stone restoration, cleaning
27 and repointing on the East Side of the State Capitol building, in a sum not
28 to exceed ........................................................$3,500,000.
29 (K) Effective July 1, 2025, the balance of the appropriation provided
30 in Item (K) of Section 1 of Act 106 of 2024, for Business and Commercial
31 Services System Update, in a sum not to exceed ...................$4,000,000.

33 SECTION 2. REAPPROPRIATION - NCRC GRANT - ARKANSAS SECRETARY OF STATE
34 HISTORIC DOCUMENT DIGITALIZATION AND PRESERVATION PROJECT. There is hereby
35 appropriated, to the Secretary of State, to be payable from the Arkansas
36 Natural and Cultural Resources Grant and Trust Fund, for the Secretary of

1 State the following:
2 (A) Effective July 1, 2025, the balance of the appropriation provided
3 in Section 25 of Act 24 of 2024, for the acquisition, management,
4 stewardship, or preservation of state owned lands, historic sites, buildings,
5 structures, or objects, in a sum not to exceed .....................$425,000.

7 SECTION 3. DISBURSEMENT CONTROLS. (A) No contract may be awarded nor
8 obligations otherwise incurred in relation to the project or projects
9 described herein in excess of the State Treasury funds actually available
10 therefor as provided by law. Provided, however, that institutions and
11 agencies listed herein shall have the authority to accept and use grants and
12 donations including Federal funds, and to use its unobligated cash income or
13 funds, or both available to it, for the purpose of supplementing the State
14 Treasury funds for financing the entire costs of the project or projects
15 enumerated herein. Provided further, that the appropriations and funds
16 otherwise provided by the General Assembly for Maintenance and General
17 Operations of the agency or institutions receiving appropriation herein shall
18 not be used for any of the purposes as appropriated in this act.
19 (B) The restrictions of any applicable provisions of the State
20 Purchasing Law, the General Accounting and Budgetary Procedures Law, the
21 Revenue Stabilization Law and any other applicable fiscal control laws of
22 this State and regulations promulgated by the Department of Finance and
23 Administration, as authorized by law, shall be strictly complied with in
24 disbursement of any funds provided by this act unless specifically provided
25 otherwise by law.

27 SECTION 4. LEGISLATIVE INTENT. It is the intent of the General
28 Assembly that any funds disbursed under the authority of the appropriations
29 contained in this act shall be in compliance with the stated reasons for
30 which this act was adopted, as evidenced by the Agency Requests, Executive
31 Recommendations and Legislative Recommendations contained in the budget
32 manuals prepared by the Department of Finance and Administration, letters, or
33 summarized oral testimony in the official minutes of the Arkansas Legislative
34 Council or Joint Budget Committee which relate to its passage and adoption.

36 SECTION 5. EMERGENCY CLAUSE. It is found and determined by the General

1 Assembly, that the Constitution of the State of Arkansas prohibits the
2 appropriation of funds for more than a one (1) year period; that the
3 effectiveness of this Act on July 1, 2025 is essential to the operation of
4 the agency for which the appropriations in this Act are provided, and that in
5 the event of an extension of the legislative session, the delay in the
6 effective date of this Act beyond July 1, 2025 could work irreparable harm
7 upon the proper administration and provision of essential governmental
8 programs. Therefore, an emergency is hereby declared to exist and this Act
9 being necessary for the immediate preservation of the public peace, health
10 and safety shall be in full force and effect from and after July 1, 2025.
