9   AN ACT TO EXEMPT PROVIDERS IN THE PROGRAM OF ALL-

10  INCLUSIVE CARE FOR THE ELDERLY FROM THE LICENSING

11  REQUIREMENTS FOR HOME HEALTHCARE SERVICES; AND FOR

12  OTHER PURPOSES.

16                       TO EXEMPT PROVIDERS IN THE PROGRAM OF

17                       ALL-INCLUSIVE CARE FOR THE ELDERLY FROM

18                       THE LICENSING REQUIREMENTS FOR HOME

19                       HEALTHCARE SERVICES.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22

23  SECTION 1. DO NOT CODIFY. Legislative findings and intent.

24  (a) The General Assembly finds that:

25  (1) Providers in the Program of All-Inclusive Care for the

26 Elderly are required to provide all-inclusive care for patients;

27  (2) All-inclusive care is often provided in homes;

28  (3) The agreements between the Centers for Medicare & Medicaid

29 Services, the providers in the Program of All-Inclusive Care for the Elderly

30 in this state, and the Department of Human Services provide that home

31 healthcare services shall be provided by providers in the Program of All-

32 Inclusive Care for the Elderly as part of their licensure; and

33  (4) However, providers in the Program of All-Inclusive Care for

34 the Elderly are not home healthcare service providers.

35  (b) It is the intent of the General Assembly to exempt or except

36 providers in the Program of All-Inclusive Care for the Elderly from the

1 licensing requirements under � 20-10-801 et seq., for home healthcare

2 services.

4   SECTION 2. Arkansas Code � 20-10-802, concerning the exceptions from

5 home healthcare services licensing requirements, is amended to add an

6 additional subdivision to read as follows:

7            (13) A licensed, certified Program of All-Inclusive Care for the

8 Elderly provider in good standing under the administration of the Arkansas

9 Medicaid Program and providing services to enrolled Program of All-Inclusive

10 Care for the Elderly participants as part of the participants' documented

11 individual care plans within the Program of All-Inclusive Care for the

12 Elderly.
