9   AN ACT CONCERNING CRIME REDUCTION AND PREVENTION; TO

10  AUTHORIZE THE DIVISION OF ARKANSAS STATE POLICE TO

11  COORDINATE WITH LOCAL SHERIFFS AND THE DIVISION OF

12  COMMUNITY CORRECTION IN CRIME REDUCTION AND

13  PREVENTION ACTIVITIES AND TO ASSIST IN PROBATION,

14  PAROLE, AND POST-RELEASE SUPERVISION SERVICES; TO

15  PROVIDE FUNDING; AND FOR OTHER PURPOSES.

19                       TO AUTHORIZE THE DIVISION OF ARKANSAS

20                       STATE POLICE TO COORDINATE WITH LOCAL

21                       SHERIFFS AND THE DIVISION OF COMMUNITY

22                       CORRECTION IN CRIME REDUCTION AND

23                       PREVENTION ACTIVITIES.

25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26

27  SECTION 1. Arkansas Code Title 12, Chapter 8, Subchapter 1, is amended

28 to add an additional section to read as follows:

29  12-8-130. Funding for probation and parole assistance.

30  After the deductions as specified in � 19-5-202 have been made and

31 before distributions provided in the Revenue Stabilization Law, � 19-5-101 et

32 seq., the Chief Fiscal Officer of the State shall transfer on his or her

33 books and those of the Treasurer of State and the Auditor of State the sum of

34 one hundred million dollars ($100,000,000) from sales and use tax collections

35 deposited into a cash fund deposited in the State Treasury as determined by

36 the Chief Fiscal Officer of the State for the Department of Public Safety --

1 Division of Arkansas State Police to be used for:

2   (1) Crime reduction and prevention programs; and

3   (2) Assistance to the Division of Community Correction in the

4 provision of probation, parole, and post-release supervision services.

6   SECTION 2. Arkansas Code � 12-8-104, concerning the Director of the

7 Division of Arkansas State Police, is amended to add an additional subsection

8 to read as follows:

9   (l) The Director of the Division of Arkansas State Police may:

10  (1) Designate officers to participate in crime reduction and

11 prevention programs and to assist the Division of Community Correction in the

12 provision of probation, parole, and post-release supervision services;

13  (2) Enter into an agreement with the sheriff of a county to:

14                 (A) Designate deputy sheriffs to participate in crime

15 reduction and prevention programs and to assist the Division of Community

16 Correction in the provision of probation, parole, and post-release

17 supervision services; and

18                 (B) Provide compensation for a sheriff's participation in

19 the agreement; and

20  (3) Coordinate with the Director of the Division of Community

21 Correction to provide assistance in the provision of probation, parole, and

22 post-release supervision services.

24  SECTION 3. Arkansas Code � 12-8-106(e), concerning the duties of the

25 Division of Arkansas State Police, is amended to read as follows:

26  (e)(1) However, this This chapter shall not be construed so as to take

27 away any authority of the regularly constituted peace officers in the state,

28 but the Division of Arkansas State Police shall cooperate with them in the

29 enforcement of the criminal laws of the state and assist such officers either

30 in the enforcement of the law or apprehension of criminals.

31  (2) Officers designated by the director under 12-8-104(l)(1) are

32 authorized to:

33                 (A) Participate in crime reduction and prevention

34 programs; and

35                 (B) Assist the Division of Community Correction in the

36 provision of probation, parole, and post-release supervision services.

1             (3) Officers designated by the director under � 12-8-104(l)(1)

2 shall not:

3               (A) Stop or detain a person without reasonable cause to

4 arrest the person;

5               (B) Conduct a warrantless search of a person or his or her

6 property; or

7               (C) Execute a warrant containing an exception to the

8 requirement for the executing officer to make known the officer's presence

9 and authority for entering the dwelling, commonly known as a "no-knock

10 warrant".

12  SECTION 4. Arkansas Code � 12-27-126(d), concerning the duties of the

13 Director of the Division of Community Correction, is amended to add an

14 additional subdivision to read as follows:

15            (6) Coordinate with the Director of the Division of Arkansas

16 State Police regarding assistance with the provision of probation, parole,

17 and post-release supervision services under � 12-8-104(l).

19  SECTION 5. Arkansas Code Title 14, Chapter 15, Subchapter 5, is

20 amended to add an additional section to read as follows:

21  14-15-507. Agreement with Division of Arkansas State Police.

22  The sheriff of a county may enter into an agreement under � 12-8-

23 104(l)(2) to designate deputy sheriffs to:

24            (1) Participate in crime reduction and prevention programs; and

25            (2) Provide assistance to the Division of Community Correction

26 in the provision of probation, parole, and post-release supervision services.
