15 TO AMEND THE LAW CONCERNING COVERAGE FOR
16 MAMMOGRAMS AND BREAST ULTRASOUNDS.

18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

20 SECTION 1. Arkansas Code � 23-79-140(a), concerning the definitions
21 used for coverage for mammograms and breast ultrasounds, is amended to add an
22 additional subdivision to read as follows:
23 (11)(A) "Supplemental breast examination" means a medically
24 necessary and appropriate examination of the breast, according to National
25 Comprehensive Cancer Network Guidelines, that is:
26 (i) Used to screen for breast cancer when there is
27 no abnormality seen or suspected; and
28 (ii) Based on personal or family medical history or
29 additional factors that increase the individual's risk of breast cancer,
30 including heterogeneously or extremely dense breasts.
31 (B) "Supplemental breast examination" includes without
32 limitation:
33 (i) An examination using contrast-enhanced
34 mammography;
35 (ii) Breast magnetic resonance imaging;
36 (iii) Breast ultrasound; or

3 SECTION 2. Arkansas Code � 23-79-140(e)(3), concerning an insured's
4 cost-sharing requirements for coverage for diagnostic breast examinations for
5 breast cancer, is amended to read as follows:
6 (3) A healthcare insurer shall ensure that an individual's cost-
7 sharing requirement under a health benefit plan that is applicable to a
8 provides coverage for diagnostic breast examination for breast cancer,
9 including breast magnetic resonance imaging, is no less favorable than the
10 cost-sharing requirement that is applicable to a screening examination for
11 breast cancer examinations, examinations for breast cancer, and supplemental
12 breast examinations shall not impose any cost-sharing requirements.
