21                       ADDITIONAL CARE AND DUTIES.

23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24

25  SECTION 1. Arkansas Code Title 20, Chapter 77, Subchapter 1, is

26 amended to add an additional section to read as follows:

27  20-77-154. Certified nurse aides providing in-home services.

28  (a) The Arkansas Medicaid Program shall authorize certified nurse

29 aides or certified nursing assistants who provide in-home services to

30 beneficiaries to perform additional care and duties if:

31            (1) The certified nurse aide or certified nursing assistant has

32 been appropriately trained on the skill that is being performed or assisted

33 with; and

34            (2) The beneficiary or the representative of the beneficiary

35 consents to the performance of the care and duties by the certified nurse

36 aide or certified nursing assistant.

1   (b) This section does not apply to a certified nurse aide or certified

2 nursing assistant who is providing services in an in-patient setting or in a

3 skilled nursing facility.

4   (c) The Department of Human Services shall apply for any federal

5 waiver, Medicaid state plan amendments, or other authority necessary to

6 implement this section.
