10 2023; TO AMEND THE UNIFORM MONEY SERVICES ACT; AND
11 FOR OTHER PURPOSES.

16 OF 2023; AND TO AMEND THE UNIFORM MONEY
17 SERVICES ACT.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21 SECTION 1. Arkansas Code � 14-1-604(e), concerning the exemption for a
22 person engaged in home digital asset mining or operating a digital asset
23 mining business under the Uniform Money Services Act, is repealed.
24 (e) A person that is engaged in home digital asset mining or that has
25 a digital asset mining business shall not be considered a money transmitter
26 under the Uniform Money Services Act, � 23-55-101 et seq.

28 SECTION 2. Arkansas Code � 23-55-102(13)(A), concerning the definition
29 of "money transmission" under the Uniform Money Services Act, is amended to
30 add an additional subdivision to read as follows:
31 (v) engaging in home digital asset mining or
32 operating a digital asset mining business under the Arkansas Data Centers Act
33 of 2023, � 14-1-601 et seq.

35 SECTION 3. DO NOT CODIFY. A person engaging in home digital asset
36 mining or operating a digital asset mining business under the Arkansas Data

1 Centers Act of 2023, � 14-1-601 et seq., as of the effective date of this act
2 shall apply for licensure under the Uniform Money Services Act, � 23-55-101
3 et seq., on or before September 1, 2026.
