2 SHARED SERVICES.
3 (a)(1) The Chief Fiscal Officer of the State may create paying accounts
4 on his or her books and on the books of the Treasurer of the State and
5 Auditor of State for the payment of all personal services and operating
6 expenses of the Department of Agriculture.
7 (2) The Chief Fiscal Officer of the State shall direct the transfer
8 of funds and appropriations to the Shared Services Paying Account
9 appropriation section of this act on the books of the Treasurer of State, the
10 Auditor of State, and the Chief Fiscal Officer of the State.
11 (3) The transfer authority provided to the department in subdivision
12 (a)(2) of this section may be used to make transfers only within the
13 department's appropriation act or between other appropriations acts
14 authorized for the department.
15 (4) The provisions of this section shall be in effect from the date of
16 passage through June 30, 2025 2026.

18 SECTION 60. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS

20 FUND TRANSFER. The Deputy Director of the Livestock and Poultry Commission,
21 with prior approval of the Arkansas Legislative Council or the Joint Budget
22 Committee, the approval of the Chief Fiscal Officer of the State, and for the
23 reimbursing of documented expenditures designated by law to be made from the
24 transferred special revenue, may transfer funds among the Livestock and
25 Poultry Equine Infectious Anemia Control Fund, Livestock and Poultry
26 Commission Disease and Pest Control Fund, Livestock and Poultry Special
27 Revenue Fund, Livestock and Poultry Commission Swine Testing Fund, and the
28 Poultry and Egg Grading Fund or from these funds to the Livestock and Poultry
29 Fund Account. The purpose of these transfers shall only be for accurate
30 allocation of incurred costs between the funds. Requests for fund transfer
31 will at least include the total amount to be transferred, to and from which
32 funds, the nature, purpose, and time period of the expenditures being
33 reimbursed, and any other information requested by the Legislative Council or
34 the Joint Budget Committee.

13 TRANSFER PROVISION. If the State Forestry Commission determines that
14 temporary firefighters, dispatchers, or pilots are required to meet the
15 demands of a wildfire season, and upon approval of the Chief Fiscal Officer
16 of the State, appropriations may be transferred from either Extra Help or
17 Professional Fees and Services to the proper character code for the
18 employment of such personnel.
19 If the State Forestry Commission determines that the deployment of air
20 tankers for fighting wildfires requires additional Professional Fees and
21 Services, and upon the approval of the Chief Fiscal Officer of the State,
22 excess appropriation in Regular Salaries or Personal Services Matching may be
23 transferred to Professional Fees and Services in the Operations and Forestry
24 - Rural Community Fire Protection - Federal appropriation sections.
25 If the State Forestry Commission determines that the most effective way for
26 it to cooperate in the growing and distribution of forest planting stock is
27 by contracting work with private vendors and/or hiring temporary employees
28 for seasonal work, the Commission is hereby authorized, upon approval by the
29 Chief Fiscal Officer of the State, to transfer the necessary appropriation
30 authorized for Extra Help and Maintenance and General Operation in the
31 Operations and Forestry - Rural Community Fire Protection - Federal
32 appropriation sections.
33 The provisions of this section shall be in effect only from July 1, 2024

2 REFUND TO EXPENDITURE. The Arkansas Forestry Commission is authorized to
3 charge fees to federal agencies and other states to reimburse the Commission
4 for expenditures made on behalf of these governmental units. These fees
5 shall be deposited into the State Forestry Fund in the State Treasury as a
6 refund to expenditure.
7 The provisions of this section shall be in effect only from July 1, 2024
8 2025 through June 30, 2025 2026.

10 SECTION 64. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
11 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY
12 FORWARD. Notwithstanding any law pertaining to the transfer of year-end fund
13 balances or any law to the contrary, any funds up to $500,000 which remain in
14 the Department of Agriculture Fund Account at the end of a fiscal year shall
15 remain in the Department of Agriculture Fund Account and be made available to
16 fund appropriation(s) authorized by law to be made for maintenance and
17 operating costs associated with wildfire suppression, as well as the purchase
18 of fire suppression equipment for the Forestry Division and made payable from
19 the Department of Agriculture Fund Account for the following fiscal year.
20 Any carry forward of unexpended balance of funding up to $500,000 as
21 authorized herein, may be carried forward under the following conditions:
22 (1) Prior to June 30, 2026, the Agency shall by written statement set forth
23 its reason(s) for the need to carry forward said funding to the Department of
24 Finance and Administration Office of Budget;
25 (2) The Department of Finance and Administration Office of Budget shall
26 report to the Arkansas Legislative Council or Joint Budget Committee all
27 amounts carried forward by the September Arkansas Legislative Council or
28 Joint Budget Committee meeting which report shall include the name of the
29 Agency, Board, Commission or Institution and the amount of the funding
30 carried forward, from the first fiscal year to the second fiscal year, the
31 program name or line item, the funding source of that appropriation and a
32 copy of the written request set forth in (1) above:
33 (3) Each Agency, Board, Commission or Institution shall provide a written
34 report to the Arkansas Legislative Council or Joint Budget Committee
35 containing all information set forth in item (2) above, along with a written

11 SECTION 65. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
12 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND
13 TRANSFER. (A)(1) If the Arkansas Department of Agriculture determines
14 additional funding is required to support the purchase of firefighting
15 equipment and forest fire suppression activities, to include the maintenance
16 and operations costs associated with fire suppression, the Department of
17 Agriculture with prior approval of the Chief Fiscal Officer of the State, may
18 transfer the sum of one million one hundred eighty thousand one hundred
19 dollars ($1,180,100) of the amount authorized for transfer by Act 154 of
20 2012, to the State Forestry Fund.
21 (2) The transfer authority provided to the department in subdivision (A)(1)
22 of this section may be used in furtherance of the State Forestry Trust
23 Program.
24 (3) The provisions of this section shall be in effect only from July 1, 2025
25 through June 30, 2026.

27 SECTION 66. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
28 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.
29 REALLOCATION OF RESOURCES. The Department of Agriculture provides a wide
30 range of services to all Arkansans. The specific service needs, along with
31 staffing required to meet them, can vary significantly due to factors such as
32 natural disasters, changing federal mandates, and job market variations like
33 wildland firefighters, dispatchers, foresters, engineers, and
34 microbiologists' shortages. These factors make it challenging for the
35 Department to accurately predict the exact needs for positions across its
36 different appropriations throughout any fiscal year. To respond swiftly to

1 changing needs and to utilize resources effectively, the Department of
2 Agriculture is authorized to reallocate resources as necessary. Upon
3 determining that a reallocation is essential for the efficient and effective
4 operation of the department, the Secretary of the Department of Agriculture,
5 with the approval of the Chief Fiscal Officer of the State and Legislative
6 Council or the Joint Budget Committee, if meeting in Legislative Session, may
7 request to transfer positions between existing business areas of the
8 department. Transfer authority shall be limited to no more than 5% of the
9 total authorized department positions in any fiscal year.
10 Determining the maximum number of employees and the maximum amount of
11 appropriation and general revenue funding for a state agency each fiscal year
12 is the prerogative of the General Assembly. This is usually accomplished by
13 delineating such maximums in the appropriation act(s) for a state agency and
14 the general revenue allocations authorized for each fund and fund account by
15 amendment to the Revenue Stabilization law. Further, the General Assembly has
16 determined that the Department of Agriculture may operate more efficiently if
17 some flexibility is provided to the Department of Agriculture authorizing
18 broad powers under the Reallocation of Resources provisions herein.
19 Therefore, it is both necessary and appropriate that the General Assembly
20 maintain oversight by requiring prior approval of the Legislative Council or
21 Joint Budget Committee as provided by this section. The requirement of
22 approval by the Legislative Council or Joint Budget Committee is not a
23 severable part of this section. If the requirement of approval by the
24 Legislative Council or Joint Budget Committee is ruled unconstitutional by a
25 court jurisdiction, this entire section is void.
26 The provisions of this section shall be in effect only from July 1, 2025,
27 through June 30, 2026.

29 SECTION 67. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
30 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.
31 TRANSFER PROVISION- NRC. At the end of each fiscal year, the Chief Fiscal
32 Officer of the State shall authorize the transfer of obligated water, sewer,
33 and solid waste funds, as provided in the appropriation act for the Natural
34 Resources Commission in the appropriation entitled "Water, Sewer and Solid
35 Waste - State", from the Miscellaneous Agencies Fund Account, to the Water,
36 Sewer and Solid Waste Revolving Fund.

6 FORWARD - NRC. At the end of each fiscal year, the Chief Fiscal Officer of
7 the State shall authorize the carry forward of funds to support the amount of
8 obligated grants that are certified by the Natural Resources Commission for
9 Matching Grants in the appropriation entitled "Water Quality Plan
10 Implementation".
11 Any carry forward of unexpended balance of funding as authorized herein, may
12 be carried forward under the following conditions:
13 (1) Prior to June 30, 2025 2026 the Agency shall by written statement set
14 forth its reason(s) for the need to carry forward said funding to the
15 Department of Finance and Administration Office of Budget;
16 (2) The Department of Finance and Administration Office of Budget shall
17 report to the Arkansas Legislative Council all amounts carried forward by the
18 September Arkansas Legislative Council or Joint Budget Committee meeting
19 which report shall include the name of the Agency, Board, Commission or
20 Institution and the amount of the funding carried forward from the first
21 fiscal year to the second fiscal year, the program name or line item, the
22 funding source of that appropriation and a copy of the written request set
23 forth in (1) above;
24 (3) Each Agency, Board, Commission or Institution shall provide a written
25 report to the Arkansas Legislative Council or Joint Budget Committee
26 containing all information set forth in item (2) above, along with a written
27 statement as to the current status of the project, contract, purpose etc. for
28 which the carry forward was originally requested no later than thirty (30)
29 days prior to the time the Agency, Board, Commission or Institution presents
30 its budget request to the Arkansas Legislative Council/Joint Budget
31 Committee; and
32 (4) Thereupon, the Department of Finance and Administration shall include
33 all information obtained in item (3) above in the budget manuals and/or a
34 statement of non-compliance by the Agency, Board, Commission or Institution.
35 The provisions of this section shall be in effect only from July 1, 2024
36 2025 through June 30, 2025 2026.

1 SECTION 70. COMPLIANCE WITH OTHER LAWS. Disbursement of funds
2 authorized by this act shall be limited to the appropriation for such agency
3 and funds made available by law for the support of such appropriations; and
4 the restrictions of the State Procurement Law, the General Accounting and
5 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
6 Procedures and Restrictions Act, or their successors, and other fiscal
7 control laws of this State, where applicable, and regulations promulgated by
8 the Department of Finance and Administration, as authorized by law, shall be
9 strictly complied with in disbursement of said funds.

11 SECTION 71. LEGISLATIVE INTENT. It is the intent of the General
12 Assembly that any funds disbursed under the authority of the appropriations
13 contained in this act shall be in compliance with the stated reasons for
14 which this act was adopted, as evidenced by the Agency Requests, Executive
15 Recommendations and Legislative Recommendations contained in the budget
16 manuals prepared by the Department of Finance and Administration, letters, or
17 summarized oral testimony in the official minutes of the Arkansas Legislative
18 Council or Joint Budget Committee which relate to its passage and adoption.

20 SECTION 72. EMERGENCY CLAUSE. It is found and determined by the
21 General Assembly, that the Constitution of the State of Arkansas prohibits
22 the appropriation of funds for more than a one (1) year period; that the
23 effectiveness of this Act on July 1, 2025 is essential to the operation of
24 the agency for which the appropriations in this Act are provided, and that in
25 the event of an extension of the legislative session, the delay in the
26 effective date of this Act beyond July 1, 2025 could work irreparable harm
27 upon the proper administration and provision of essential governmental
28 programs. Therefore, an emergency is hereby declared to exist and this Act
29 being necessary for the immediate preservation of the public peace, health
30 and safety shall be in full force and effect from and after July 1, 2025.
