17 TO AMEND THE LAW CONCERNING SELF-SERVICE
18 STORAGE FACILITIES; AND TO REQUIRE
19 NOTIFICATION BY A SELF-SERVICE STORAGE
20 FACILITY TO AN OCCUPANT WHEN THE
21 OCCUPANT'S LEASED SPACE IS COMPROMISED.

23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25 SECTION 1. Arkansas Code Title 18, Chapter 16, Subchapter 4, is
26 amended to add an additional section to read as follows:
27 18-16-416. Compromised leased space -- Notification required --
28 Definitions.
29 (a) As used in this section:
30 (1) "Compromised" means that an operator has actual knowledge
31 that:
32 (A) A leased space has been forcibly accessed by an
33 individual other than the occupant, the operator, or an individual authorized
34 by the occupant or the operator;
35 (B) Property has been taken from a leased space by an
36 individual other than the occupant, the operator, or an individual authorized

1 by the occupant or the operator; or
2 (C) A leased space has been damaged to the extent that
3 property within the leased space is accessible by an individual other than
4 the occupant, the operator, or an individual authorized by the occupant or
5 operator; and
6 (2) "Individual authorized by the occupant or operator" means an
7 individual listed on the rental agreement or an individual who has the
8 applicable key or code to access the leased space.
9 (b) An operator shall contact an occupant who has a compromised lease
10 space by telephone, email, or regular mail within five (5) business days of
11 the operator's actual knowledge that the occupant's leased space has been
12 compromised.
13 (c)(1) This section does not impose any responsibility on the operator
14 for the care, custody, or control of the occupant's personal property.
15 (2) The operator does not have a duty or obligation to determine
16 whether a leased space has been compromised.
