12 REGISTRATION ACT OF 1997; TO AMEND THE LAW CONCERNING
13 THE ISSUANCE OF LICENSES AND PERMITS; AND FOR OTHER

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code � 12-12-913(a), concerning a disclosure of a
25 person's status as a registered sex offender, is amended to add an additional
26 subdivision read as follows:
27 (4) Registration records shall be open to the Office of Motor
28 Vehicle of the Department of Finance and Administration for the issuance of a
29 driver's license or identification card to a registered sex offender under �
30 27-16-819.

32 SECTION 2. Arkansas Code Title 27, Chapter 16, Subchapter 8, is
33 amended to add an additional section to read as follows:
34 27-16-819. Designation for registered sex offender.
35 (a)(1) Before the Office of Driver Services issues a driver's license
36 or identification card to an applicant, the applicant shall provide

1 information to the office concerning whether the applicant is:
2 (A) Required to register as a sex offender under the Sex
3 Offender Registration Act of 1997, � 12-12-901 et seq.;
4 (B) Currently registered as a sex offender under the Sex
5 Offender Registration Act of 1997, � 12-12-901 et seq.; and
6 (C) Classified as a Level 3 or Level 4 sex offender by the
7 Community Notification Assessment.
8 (2) The office shall place a designation on an applicant's
9 driver's license or identification card sufficient to enable a law
10 enforcement officer to identify the holder of the driver's license or
11 identification card as a registered sex offender subject to the Sex Offender
12 Registration Act of 1997, � 12-12-901 et seq., if the applicant is:
13 (A) Required to register as a sex offender; and
14 (B) Classified as a Level 3 or Level 4 sex offender by the
15 Community Notification Assessment.
16 (3) Before the office issues a driver's license or
17 identification card to an applicant who is required to have a designation
18 placed on his or her driver's license or identification card under this
19 section and who has not previously had a designation placed on his or her
20 driver's license or identification card under this section, the applicant
21 shall provide proof to the office that the applicant is registered as a sex
22 offender in compliance with the Sex Offender Registration Act of 1997, � 12-
23 12-901 et seq.
24 (b) The office may:
25 (1) Determine the appropriate placement and design of the
26 registered sex offender designation on a driver's license or identification
27 card authorized under this section; and
28 (2) Promulgate rules for the administration of this section.
